Re: Religious Test for Immigration/Refugee--Lawsuits?

2017-01-31 Thread Nelson Tebbe

According to the law librarians here, Judge Gee amended the order in Vayeghan.
It still finds a likelihood of success on the Establishment Clause claim, but
it downgrades Kiryas Joel to a cf. citation. The passage Micah quoted now reads:

  1. Petitioner has demonstrated a strong likelihood of success in
establishing that removal violates the Establishment Clause, the Immigration
and Nationality Act, and his rights to Equal Protection guaranteed by the
United States Constitution. See 8 U.S.C. §§ 1151, 1152(a)(1)(A) (“[N]o person
shall receive any preference or priority or be discriminated against in the
issuance of an immigrant visa because of the person’s race, sex, nationality,
place of birth, or place of residence.”); cf. Board of Educ. Of Kiryas Joel
Vill. Sch. Dist. v. Grumet, 512 U.S. 687, 696, 702–703 (1994).

In Vayeghan, Judge Gee issued an order on Sunday (1/29) and found, in part,
that:

Petitioner has demonstrated a strong likelihood of success in establishing that
removal violates the Establishment Clause, the Immigration and Nationality Act,
and his rights to Equal Protection guaranteed by the United States
Constitution. See 8 U.S.C. §§ 1151, 1152(a)(1)(A) (“[N]o person shall receive

Board of Educ. Of Kiryas Joel Vill. Sch. Dist. V. Grumet, 512 U.S. 687, 696,
702–703 (1994); Vill. of Arlington Heights v. Metro. Housing Dev. Corp., 429
U.S. 252, 266–67 (1977).
