but it was over 1 year from his conviction date and he contested that the fcc 
did not act in a timely manner and stated his licences were still valid, and in 
protest he started broadcasting taped messages on all the local repeaters and 
on the linked systems it carried to several states. He also has done this to 
MARS and other services. one occasion he went in to the LA vets hospital and 
droped off one of his jamming packages, (a handheld and a tape recorder) the 
vet hosp police detained him and called the bomb squad to destroy the

Hello All,
   Today about 08:45 In El Monte Court, Division 4 Judge Craig Mitchell held 
the sentencing hearing for Jack Gerritsen.  The Judge acknowledged over 80 
Emails as well as a stack of letters from the regular mail.  He said he read 
them all.

Three persons were permitted to speak, the Victim who brought the charges, 
Deputy Burton Brink L.A.S.D. who has been quite active in getting Gerritsen 
prosecuted and myself.  We all painted him as a sociopath who had no regard for 
the rights of others and a propensity to interfere with emergency 
communications.

The Judge told Gerritsen that he was no more than an adult version of a school 
yard bully as proved by his own testimony that he kept getting bigger 
amplifiers until no one could talk over him.

Judge Mitchell acknowledged the Amateur service as providing a valuable public 
service in times of emergency.

The Judge handed down a sentence of 120 days less 5 days for time served 
followed by 3 years of probation. a fine of $1000.00 + assessments which came 
to $3876.00 and must be paid within 1 year.

The Maximum sentence would have been 6 months but at the end of that six months 
Gerritsen would have been free and clear.  the 120 day sentence allowed the 3 
year probation to follow.

Probation conditions:
1) Gerritsen may not transmit on Ham radio without a valid FCC License.
2) He can not violate any law.

A Penal Code 136.2 protective order was issued for the Victim and 3 other 
individuals.

Gerritsen's Federal trial will be early in October.  Plans are to select a Jury 
in the October 3 to October 5 time frame.  When the actual date is available 
I'll forward it.

Some letters of appreciation should be sent to DA Rusty Moore's Supervisor.  
Rusty put his heart and soul
into prosecuting this case.  Personally, he called me a half dozen times during 
the trial for information, and recordings.  I know that he also contacted 
others as well.  Rusty even offered to meet me at my home and at my convenience 
to discuss the Gerritsen case specifically and Ham radio in general.

I doubt if any DA has ever put forth more effort in prosecuting a case than has 
Rusty on this one.

A special thanks to those who have assisted in this case with their letters and 
other information as well as the (approximately) 41 persons who more than 
filled the courtroom at todays hearing.
