In 1999 the Institute of Medicine (IOM) released their stunning 
findings on preventable deaths in hospitals in their report 
entitled To err is human. The IOM went so far as to say that 
preventable deaths in America's hospitals should be considered a 
national epidemic. The IOM study found that between 44,000 and 
98,000 deaths in hospitals are attributable to medical errors 
each year. 

This makes medical errors the 7th leading cause of death in 
America, ahead of motor vehicle accidents, breast cancer, and 
AIDS. Another study on wrongful deaths was conducted in 2003 and 
was published in the Journal of the American Medical Association 
(JAMA). This study, conducted by Healthgrades, showed that from 
the years 2000-2002 wrongful deaths in hospitals were actually 
more than double what the IOM reported. Healthgrades study showed 
that as many as 195,000 people suffer from wrongful death in 
American hospitals each year.

There are a number of reasons why these wrongful deaths happen 
each year in hospitals. Over worked doctors, medication errors, 
and inadequate staffing all lead to tragic preventable deaths. 
This has led to new rules regulating the number of hours that 
medical residents can work in a week and strict enforcement of 
these regulations. Medication errors have led to double and 
triple checking dosages and medication interactions. Inadequate 
staffing has led to hospitals being forced to close their 
emergency departments when staffing is inadequate. Despite these 
efforts to improve medical care, wrongful deaths still happen in 
hospitals everyday.

If you are the family member of one of these victims, chances are 
you do not care why this happened; you simply want justice for 
your loved one. If you are counting on your insurance company to 
bring justice you are wrong. The reason that the insurance 
company will not help you is complex. Insurance companies are 
primarily concerned about making a profit, not seeking justice. 
Let us assume that you have had a family member suffer a wrongful 
death in a hospital. Now if your insurance company seeks to 
penalize this hospital, the insurance company risks losing their 
contract with the hospital. If this happens, the insurance 
company has one less place to send the people that they cover. 
The insurance company also does not want to see this happen 
because they are getting a discounted rate for services from this 
hospital. Additionally, the insurance company can use this 
preventable death case as leverage with the hospital to further 
reduce the rates that they pay the hospital in future contract 
negotiations. While all of this may sound cold blooded and 
heartless, it is a reality.

The hospital and the physician want to quickly and quietly settle 
with the victims family members in order to avoid bad press. The 
hospital will do everything that it can to get the family members 
to sign off on a settlement, as will your own insurance company. 
This is not the justice that the victim of a wrongful death 
deserves. This is why choosing a competent and experienced lawyer 
is in your best interest.

Motorcycle riders often get an unjustified reputation as being 
reckless, risk takers, and that they generally disobey traffic 
laws. This perception is unfounded and there are many statistics 
that back up the fact that most motorcycle accidents are not the 
fault of the motorcycle rider, but that of another driver.

A major study conducted by the University of Southern California 
(USC) found that approximately three-fourths of motorcycle 
accidents involved a collision with another vehicle, usually a 
passenger automobile.  It was also found that in the multiple 
vehicle accidents, the driver of the other vehicle violated the 
motorcycle right-of-way and caused the accident in two-thirds of 
those accidents. Further the study by USC found that the failure 
of motorists to detect and recognize motorcycles in traffic is 
the predominating cause of motorcycle accidents. The driver of 
the other vehicle involved in collision with the motorcycle did 
not see the motorcycle before the collision, or did not see the 
motorcycle until too late to avoid the collision.

These findings go to show that the motorcycle rider has unjustly 
received a bad reputation from the general public as well as from 
insurance companies that cover motorcycle riders. Motorcycles are 
inherently prone to accidents caused by other drivers because of 
their small size. Motorcycles easily fit into the blind spot of 
typical passenger automobiles. The truth is that most motorcycle 
riders are very good drivers and keep an eye out for motorists 
who do not see them. This awareness of other drivers however does 
not prevent all accidents.

When accidents such as these happen, the insurance company of 
the driver who is at fault will go to great lengths to keep 
from giving the motorcycle rider the money he or she deserves. 
Insurance companies will frequently rush the victim to make a 
quick settlement as a way to save money. Most people in the 
general public are not insurance experts and do not know if they 
are getting a bad deal from the insurance company or not. When a 
check is stuck in front of them it can be quite tempting to sign.

Taking the insurance companies first offer is usually a mistake. 
Other times the insurance company of the other driver will try 
to not pay at all for the accident and resulting injuries. They 
often try to make it appear that the motorcycle rider was at 
fault in the accident. It is not hard to convince a jury of this 
since motorcycle riders have this unjust reputation of being less 
than careful.

This is why it is critically important to have a qualified and 
competent lawyer on your side if you find yourself the victim of

that you get the settlement that you deserve; a settlement that

Every year thousands of people suffer serious personal injuries 
as a result of being the passenger in an automobile accident. 
About 3,200,000 passengers in an automobile each year are injured 
in automobile accidents. Approximately 41,000 fatalities resulted 
from these accidents. 

There are many ways in which a person can suffer injuries as a 
passenger in an accident. The most frequent example is that of 
being a passenger in an automobile accident. If the driver of the 
vehicle that you were riding in is at fault, his or her insurance 
should provide coverage to pay for you injuries and medical 
bills. If another vehicle is at fault, the insurance company of 
the driver who caused the accident should provide compensation. 
Insurance companies will often try to not pay you what you 
deserve, or will try to not pay you at all for injuries suffered 
as a passenger. The insurance companies may claim that since they 
do not cover you that you are on your own. They may even try to 
fault you in some form or fashion.

Motorcycle passengers frequently receive much more serious 
injuries if involved in an accident due to the lack of safety 
equipment on motorcycles. Another scenario where passengers 
suffer vehicle injuries is when they are passengers in a 
commercial vehicle. These commercial vehicles can include 
taxicabs, busses, and airplanes. Passengers have the right 
to be covered in these instances as well. 

In all of these scenarios, the passengers have rights that they 
are frequently unaware of. Insurance companies will offer you a 
quick settlement just to get you to sign off and to sign away 
your rights for further compensation. What the insurance 
companies do not tell you is that passengers are entitled to 
additional compensations besides just medical fees. 

Some of the other things that are covered by insurance companies 
to passengers include:

 * Rental reimbursement
 * Compensation for future medical bills
 * Medical treatment, whether you have insurance or not
 * Recovery of your loss of earnings and any future losses
 * Reimbursement for out of pocket expenses incurred

The items listed above are entitlements to passengers in 
automobile accidents that many people do not know about. 
Insurance companies generally will not let you know that these

Being in an automobile accident can be a very traumatic and 
trying experience. Unfortunately, once the wreck is over the 
problems can still continue. It is estimated by the National 
Safety Council that there are more than 12 million auto accidents 
annually, including more than 20 million vehicles. This creates 
a situation for the automotive insurance companies that can be 
quite expensive. Insurance companies are always looking for ways 
to save money and cut costs. One way that they do this is by 
working very hard at not paying you any more than they have to, 
if you are in an automobile accident. At times the insurance 
companies will try to not pay you at all for your car's damages. 

Even a small fender bender can result in hundreds of dollars 
worth of damage. A small dent on the rear quarter panel of a car 
will be very expensive to fix at a body shop. These minor dents 
and dings are why insurance companies entice people to agree to a 
deductible when creating their policy. It is no coincidence that 
the amount of many deductibles is $500-$1,000. Many very minor 
dents and dings will not result in enough damage to go over your 
deductible and your insurance company will not have to pay 
anything. 

If you are involved in an automobile accident, you may think that 
your insurance company is on your side, but in reality they are 
on their own side and want to save themselves money. Let us take 
a look at an example. A person just purchased a car and has full 
coverage insurance on that vehicle. Two weeks later that person 
is involved in a major accident. The insurance adjuster declares 
that the car is totaled. This means that the expense of repair 
exceeds the vehicles Blue Book value. A blue book is one of the 
primary resources that insurance adjusters and car dealerships 
use to determine the value of any car. 

So the insurance adjuster said that the person's car is a total 
loss, but the blue book value is only $7,000 and the person paid 
$10,000 for the car. Where does that other $3,000 come from? That 
loss is expected to be absorbed by the unlucky owner of the car. 
Does this sound like a fair deal for the person who has only 
owned his or her car for just two weeks?

A situation such as the one described above is why you need a 
qualified and competent lawyer, who is on your side. In many 
instances a lawyer will be able to recoup the full price that 
you paid for the car, not just the blue book value. Even if 
your car is not new, you may have spent a great deal of money on 
maintenance repairs recently, and insurance companies generally 
do not pay for that either. A lawyer will be able to help you in 
instances such as these also. 

The insurance companies have lawyers working for them to help 
keep them from paying anymore than they have to. Most people are 
not aware of how much they can get from their insurance company, 
in case of an automobile accident, and insurance companies like
