The deposition is scheduled as part of a lawsuit filed by the NCAA and the American Football Coaches Association asking a court to rule that coaches can't be subject to defamation claims for statements they make during NCAA investigations. Fulmer has joined that lawsuit as a plaintiff. Fulmer's attorney, Jeff Hagood, said the lawsuit involves only a question of law, not any disputes of fact, so there is no need for discovery of facts through depositions. We don't expect to engage in a lot of discovery, Hagood said. The lawsuit was filed in Knoxville by the NCAA and the AFCA following a lawsuit filed by former UT player Kenny Smith, his father and his mother, accusing Fulmer of defaming Smith's mother by telling an NCAA investigator that she might have had an affair with a former University of Alabama assistant football coach. That suit was dismissed in Tuscaloosa County over jurisdiction issues. Montgomery attorney Thomas Gallion said he expects that suit will get re-filed in Tennessee, where the Smiths now live. Gallion is also lead counsel for former UA assistant coaches Ronnie Cottrell and Ivy Williams, who are seeking $60 million in a lawsuit against the NCAA and others after they lost their jobs in the aftermath of a recruiting scandal that ended with Alabama on probation. Gallion hopes to get a deposition from Fulmer in any of the related lawsuits so he can try to prove his contention that Fulmer helped organize a conspiracy against Alabama. But Hagood said, All these requests are pure grandstanding. It's to try to get you to write a story about them. Phillip Shanks, a Memphis attorney who is a member of Team Cottrell, filed the court document scheduling Fulmer's deposition in Knoxville. Hagood said he hasn't seen it yet. Shanks said: I have to observe that Mr. Hagood seems awfully intent on keeping us from asking his client a few questions. Mr. Fulmer, as I recall, didn't show up in Birmingham in July (at SEC Media Days) because he was afraid to give a deposition. Now, it sounds like he doesn't want to show up in his own city. Bottom line, he's a plaintiff (in the AFCA lawsuit), and I don't understand how he can object in good conscience as a plaintiff to answer some questions from the people he has sued. Also Tuesday, Gallion said he would not be on hand if Fulmer gives a deposition in Knoxville. I'm not going to Knoxville, Gallion said. I don't have a license to practice in Tennessee, but I am going to be involved in preparing the questions for the deposition. Gallion said that although the deposition would be directly related to Fulmer's suit against the Smiths, his testimony would also be relevant to the Cottrell case. That's because of Fulmer's statements reported in documents written by NCAA investigator Richard Johanningmeier that were released through the federal probe in Memphis of former Alabama booster Logan Young, Gallion said. In those documents were the defamatory statements on Kenny Smith's mother, Gallion said. Those very same documents, primarily statements of Rich Johanningmeier, went to the Justice Department, which went to the grand jury and then to the public eye. It was all tied together. All of it is relevant, but what he will testify to, I don't know. He ain't held his hand up to God. He may show up, but if I were a betting man, I'd say he will try to pull something to get out of it.
