I am not a legal expert, but I would think that this is a case that
can be considered based on principles. Given that Emacs is universally
held to be a quasi-OS, perhaps a special provision can be made.

I am copying the Savannah hackers list so we can get an authoritative
answer over there.

 Description: 
This program is a layout descriptor image file converter from CloneCD (.CCD)
format to Cue Sheet format (.CUE), mostly common in unix system's CD burning
software. The purpose is to provide a way to burn images files generated in
foreign (proprietary) plataforms like Windows inside a GNU/Linux system. Many
CD's images files based on mixed audio-data layout are spread over the
internet. An example are the PSX's games. I searched for, but don't found a
way to burn thats files under GNU/Linux. Then, I decided to write this small
tool. The source code was written entirely in C and only requires GCC to
build. I have tested it with 4.4.5 version.

gcc 4.4.5 + GPL 2.0 or later + http://gcc.gnu.org/
