I'm about the same way. Got no problem with someone using a description if
they at least mention it came from my site. However I don't like my pics
being used at all. When people see a picture, they tend to assume that's
what's being auctioned, and sometimes neglect to even read the text. I've
seen people show images of a shrinkwrapped game when selling an open one,
and of course you get the "here's what the box looks like even though I'm
only selling a loose disk" variety.

You got off easy. One of my auction thieves' relist declared, "This auction
has been censored by some anonymous coward." B-) It didn't sell either.

eBay is actually very responsive to incidents like this. In all the cases
I've reported they've taken the offending auctions down within a day.

Right now I've got a query that pulls part of my vault page text, then
searches eBay for the exact text. It's a random sample, but as I run it
several times a week, it usually catches plagiarists.

Wow, and he's even leeching bandwidth from The Underdogs in order to show
the incorrect box shot and screenshot (does the same for the Loom auction).
He's not only being dishonest but inconsiderate of the already hefty

Re: [SWCollect] Our Mission

2002-08-01 Thread Stuart Feldhamer

As this is my first post to this list, allow me to say hello. I have been
lurking for a few weeks, and while that probably isn't long enough, I had
something to add here. If I'm missing some important etiquette, please let me
know.

Loom CD is a fairly rare game. Admittedly, the boxed version is much more
desirable, but the fact that this OEM version is shrinkwrapped makes it still
somewhat of interest, if not to collectors, than to the general public.

I got an OEM version of Loom with my first CD-ROM drive back in 1992, and
loved the game. Somehow my copy got lost though, and I wanted to buy a new
one, but I was unable to find a copy. This was before Ebay was big. CD Access
found a bunch so I bought one from them for $15 just before their stock ran
out. Then, on a trip to Canada, I found a small computer store that had around
15 copies of Loom CD OEM for $2 each. Now, of course, I should have bought all
of them, but stupidly, I only bought 5 copies. I ended up selling each copy
for $75 each via the 'net. Why? Because the game is excellent, and the CD
version is hard to find. Also, the boxed version of this game is particularly
rare. The list price on it was $79.95 when it was released, more than most
people were willing to pay, and I believe it was distributed by the Software
Toolworks rather than Lucasarts, and probably had a small print run. So $75
for a new copy of this game, even in OEM, is not outside of the realm of
sanity.

Also, I want to point out that this is a buy it now price, not an opening bid.
A buy it now price should be on the high end. It's what the seller will
happily take to end the auction immediately. So I personally don't see
anything wrong with this auction listing.

I've had something similar happen. Someone was auctioning off a Rom
action figure using a picture from my site
(http://home.hiwaay.net/~lkseitz/comics/Rom/). I contacted the seller
and he added text to his auction stating that the image was not the
actual figure he was selling and, I believe, included the URL of my
page. So not everyone on eBay is unreasonable.

OTOH, I stamp all scans I make specifically for eBay with "lkseitz" (my
eBay i.d.) so others can't use them. Or at least not claim that they
are theirs.

Re: [SWCollect] Our Mission

2002-08-01 Thread Marco Thorek

I once had this case where a young lady from England tried to sell a
couple of Infocom games via ebay.com. I stumbled across them and lo and
behold, the pictures she used were taken from my Infocom site.

Now, I don't really have a problem with people using my scans, provided
they a) ask me before they do and b) make the bidders aware the image
does not show the actual item. The latter because most of my images are
heavily retouched to give perfect appearances - it would severely
mislead buyers about the condition of the actual box sold.

Trying to play nice I got in contact with the young lady first, and made
her aware that I'm aware. She denied using my images. So I filed a
complaint with ebay and after some forth and back and finally having me
swear that the images are indeed mine and that in the case I lie
devastating punishments would fall upon me, ebay removed the auctions.

Young lady relisted her items with the small addition "item relisted due
to picture copyright issues" and they unfortunately then went unsold.
The previous bidders did not feel inclined to bid again.

Lesson to learn: Ebay is *not* powerless and what holds true for
pictures is also true for text. Both fall under copyright law if they
are your original work.

To prevent future incidents like this I now stamped most of my images
with my URL and because of the growing number of people remote linking
my images I started to block hits on them via .htaccess, when the
referring URL does not come from my domain.

Hello,

Jim, your dream is very nice, I thought of similar ones several times but it's probably more unpractical than imagining a perfect country follwowing Plato's or Thomas More's ideology...

I try to bring more and more collectors to our mailing list, so we can at least share our education with them. Maybe it won't work on some, but it will definitely be useful for a good % of them.

Just to be the Devil's advocate as usual... about Mayor's "Loom" auction, from the description I can tell it _is_ a brand new item, complete: it's the OEM version, shrinkwrapped, hence no box.

On the Martian Memorandum one, at least he mentions that it's a compilation... you wouldn't dream the amount of sellers on the biggest portuguese auction site (www.miau.pt) auctioning pirated copies and saying they're originals...

All the best to all of you,
Pedro

Re: [SWCollect] Our Mission

2002-08-01 Thread C.E. Forman

I know this guy. He's one whose auctions I've canned for swiping YOIS text
word-for-word. It's amazing how someone can be a power seller yet also be
so thoroughly ignorant. (Notice too, that everything is Ultra-RARE,
including Zork I, one of the bestselling games of all time.)

[SWCollect] Our Mission

2002-08-01 Thread Jim Leonard

..is to help educate people like this:

http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=1370275065

He admits there is no box and the contents are incomplete, yet he asks a Buy
It Now price of $70.

I look forward to the day -- probably about 2 years from now -- when
collectors all over the world are:

1. Unified in their usage of grading terms
2. Within reasonable estimates of the value of an item
3. Don't try to pawn off garbage with punk-ass wack auction listings like this
(or this:
http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=1370272675&ssPageName=ADME:B:SS:US:1

-- it's a compilation CDROM, not the original package, yet he displays the
original packaging)

Then again, I am probably dreaming. In fact, I know I am.
