I just remembered two things: Particularly nasty wording or harsh language or
accusations are not good practice for cease and desist letters. Also, if you
threaten legal action, be prepared to actually follow up on it. Don't make
legal threats unless you're serious.

Thanks Jim. I just wanted to make sure people acknowledge that I know
what I'm talking about, so that when I ask them to -please- remove the
content or at least mention the source, I'm taken serious. I'm not going
to start cross-atlantic court action over it (he, imagine that!).

About the RPG main genre: You probably know more games than anyone else
under the sun, but nobody is perfect. Well, the Pope claims to be, but
who wants to be like the Pope? ;-)

Hm, can you give me a sample of the cease desist? I'm not that
familiar with the US legal system and having that could come in handy.
Just recently I found another site that lifted some of the bios I
compiled on the Infocom authors in their entirety.

A proper cease and desist letter would be something that has three paragraphs:

- First paragraph introduces yourself or your identity, and links you to the
intellectual property you are going to talk about
- Second paragraph lists the infractions (what the guy is doing wrong)
- Third paragraph asks that the person cease and desist (exact wording is
important!) said behavior

None of these paragraphs necessarily need to be very long, or even formatted
into three paragraphs, but it's typical form if you're not a lawyer. (If you
are, or want to sound like one, then here's an actual cease and desist letter
to use as reference:
http://www.mobygames.com/featured_article/feature,7/section,23/

Personally, I just shot him a quick note:

Hi, I noticed in this auction that you are using images from MobyGames.com
without our permission. Please cease and desist this immediately or will be
forced to take action which includes, but is not limited to, contacting ebay
in regards to having your account suspended or revoked. Your prompt attention
in this matter is greatly appreciated.

I didn't want to go into it much because I wasn't expecting a reply. As it
turns out, he promised not to do it again, so I left it at that.

(PS. RPGs sure look great there among the main genres ;-)

Yeah, rub it in... :-) You have to know it was a blow to my ego that I
royally screwed that up. And Hack was one of my first addicted games, even!!
How could I have blown it? Oh well; it's fixed for all eternity now.

I'm not doing enough to need the info at the moment.

By the way, is this auction
 http://cgi.ebay.com/ws/
 eBayISAPI.dll?ViewItemitem=3008172904category=11050 legitimately
 using Moby Games images?

Of course not. The only auctioneers we permit to use our images are members
of this list, and only with some note that says the images are used with
permission and providing the URL of mobygames.

I have emailed the person. Thanks for the heads-up. Normally I wouldn't give
a crap, except that this guy was not only using multiple images, but doing so
to totally misrepresent the product (the covers aren't part of the item!).

Actually, Jim, this brings up something I wanted to ask you: Would it be
possible for me to get a basic list of gameID, title, and publisher from
Moby? I've considered setting up links from my trade and vault items to
MobyGames, if additional info on the games exists... with your permission,
of course. Like what GameTZ uses.

How about what GameTZ uses *exactly*? Here's the link:

 http://www.mobygames.com/misc/ugtz_download

I cleared it with my partners, so you (and any other website implementors on
this list) are allowed to use it provided that you make it obvious you are
linking to MobyGames somehow, either through text or a tiny graphic or
something. (Link text of just more info, etc. would not be enough.) We
provided the little icon that UGTZ/GameTZ uses, so feel free to save it from
their pages and use it. If you need larger icons or ads, you can find them
 here: http://www.mobygames.com/info/link/

The output of the above link is very simple:

 Banjo-Kazooie; Nintendo 64; http://www.mobygames.com/game/sheet/gameId=3583
 Sonic Adventure; Dreamcast; http://www.mobygames.com/game/sheet/gameId=3530
 Quake II; DOS; http://www.mobygames.com/game/sheet/gameId=405

..etc. For older PC games, most collectors on this list will only look at
the DOS and Booter platforms. Sorry, no C64 or Atari yet, but they are
 planned to be implemented.

If you have any questions, just ask. Again, our only requirement is that you
make it obvious it's MobyGames you're linking to. Automatically pulling the
info up in framesets or otherwise disguising MobyGames' information will
probably get us miffed :) Otherwise, enjoy!
