So that means that if tomcat is run under 1.2, then the servlets
that it runs are also run under a 1.2 jvm ?
Is there any thing in tomcat that depends on 1.2 ?

It sounds as if your java 1.2 for freebsd is buggy, nearly everyone uses a
version of java 1.2 with tomcat.
