I can confirm this issue in Ubuntu 9.10 and OOO310m19 (Build:9420) Using a black theme with white menu text, menu headers display black text, making it impossible to read. I'm testing 10.04 Netbook Edition right now and with the default theme the menu headers in OpenOffice are impossible to read, eg. black text on brown background.
