Surely thats just splitting hairs? I'm pretty sure anyone can get access
to AN email account whether it be yours or otherwise. You can still get
open access to it :)

Re: [ubuntu-uk] Linux to appear on every Asus motherboard

2008-05-15 Thread Ciaran Mooney
The GPL v2 says

b) Accompany it with a written offer, valid for at least three
years, to give any third party, for a charge no more than your
cost of physically performing source distribution, a complete
machine-readable copy of the corresponding source code, to be
distributed under the terms of Sections 1 and 2 above on a medium
customarily used for software interchange; or,

This to me says they have to provide me with a CD, at a cost to
myself, priced by how much it costs to make the CD.

Now I may not read english, but that doesn't mean I should still be
denied the freedom to obtain the source. I would just consult someone
who could.

What if you were homeless and living on the streets, with no computer?
How much effort do they need to put in to tracking you down to give you
a copy of the source?

IMO, It is not unreasonable to assume that someone with a computer has
an email address.

You could give DeviceVM a ring at +1.408.861.1088, or visit their office
at

1054 S. De Anza Blvd, Suite 200
San Jose, CA, 95129
U.S.A

or use their contact form on the website to politely ask for a copy of
the source code.

On a more serious note, I think that is an invalid comment to make. More
than 99% of the world population lives without internet access, thus
they cannot access any source code whatsoever. Is Linux less open
because my grandmother can't read English, thus the source code has to
be translated for her?

IANAL, but I think that the GPL requires people who want the source to
be given access to it. You have gained access to it, and although this
is not as 'open' as putting it up for download straight off the site,
the source has been given to you.

I would not be surprised if it does include some proprietary bits, the
EEE for example has a relatively large amount of proprietary stuff
built into the os.

asking if you want to join a Dev mailing list.

Re: [ubuntu-uk] Linux to appear on every Asus motherboard

2008-05-14 Thread Jai Harrison
I'm having trouble identifying if this is free software or not.

I took a look on Wikipedia and it stated that it is a "proprietary
model", whatever that means. Then I took a look at the website and it
requires you to provide them with personal details to be sent a link,
by e-mail, to the source.

The Wikipedia article seems to link to an e-mailed ID access to the
source. So I downloaded the source that is provided but my poor
programming experience means I was unable to identify if it is
complete or not.

One thing I would note is that the software is covered by the GPL
license yet they require you to provide them with an e-mail address to
be given access to it.

Motherboards have been sold with this software on, right? If that's
the case then surely this is a violation of the GPL.

Very cool, it seemed to big news about a year ago, but then fizzled out. Asus
look to be getting involved with a lot of linuxy things recently.
