Doesn't seem that bad to me. I could agree that it's against the spirit of open source, but they've put a ton of time and money into promoting the brand of ubuntu and I don't think it's unreasonable for them to be wary of allowing very negative websites using that branding to go unanswered. I don't think is trademark law to silence a critic. I think it is trademark law to protect a trademark. Was news to me though and I am checking into it. I can see both sides of the coin on this one. However, I feel that Ubuntu should be more transparent about their search/privacy policy and be upfront with users about having the option to disable the search function, if so desired.
