Madeleine Kronovet at the DP.   I have spoken with Madeleine numerous times,
and she does try to understand  the complexities of the zoning process.  In
fairness, zoning can be  difficult to follow for people more familiar with
it.  For students,  even DP reporters who have never been exposed to the
process or attended a  Zoning Board of Adjustment hearing, the process can be
a mess.  I hope  that my previous e-mail helped to straighten out where
things currently  stand.  The issue of the wine and spirits shop is before
the city's  zoning board, discussions are continuing between the Mosque and
owners of the  former Rite Aid property, and the case is scheduled to be
heard on the 21st  of March.  I should have expressed less frustration with
the confusion  on the part of the DP staff.  They really are conscientious
and they are  trying.  It is simply that misinformation on complex issues can
create  problems for everyone.  I would appreciate it if you would post this
on  the list serve.  Madeleine and the other DP reporters should be  treated
with more kindness and  forbearance.

[UC] Comlimentary Tickets for Penn/Brown

Hot off the presses!  Penn, through its office of Community Affairs, has
generously made 50 tickets to Saturday night's Penn/Brown game.   

Although I do not know everyone on these neighborhood listservs, we are
always happy to meet new neighbors.  As a previous email stated, Denise and
I are having a pre-game reception this Saturday, March 3 from 4PM until 6PM,
leaving us plenty of time to get to the 7PM tip-off at the Palestra.  It
should be a great college game, giving Penn some momentum going into the
March Madness of the NCAA Tournament (presuming they win a game or two this
weekend). 

Although Penn basketball games are cheap, since some of you are even
cheaper, we expect to see you. 

Although I should have enough tickets for everyone, just in case there is an
overwhelming response, let me know if you want tickets and how many.  It is
not necessary to annoy me with emails telling me that you can not come, only
if you need tickets.

Public Transportation from Center City: 
Take the Subway-Surface Trolleys (Green Line) West to 43rd Street.  You can
pick this up downtown along Market Street at 13th, 15th, 19th or 22nd, as
well as at 30th Street Station.  You may take any of the lines EXCEPT the

I'm still waiting for Al Krigman to give us his opinion of landlord Dan 
DeRitis' capabilities, as related to Dan's possible new tenant, a Wine & 
Spirits 
shop at 4237 Walnut St.

Meanwhile, here's an article from today's Inquirer about the confusing system 
now in place.   Says Nutter:  "If people can see what's happening and 
understand it, I think they wouldn't automatically say, 'Stop.' "

Nutter: Reduce zoning board role

 Democratic mayoral candidate Michael Nutter said yesterday that he would 
reduce the role of the Zoning Board of Adjustment as part of his plan to 
modernize and rationalize zoning and planning in Philadelphia.
 At a news conference in Old City, Nutter proposed a thorough rewrite of the 
city's zoning code, which was last done in 1963. In addition, he would order a 
reinvigorated city planning commission to spend the next few years creating 
community master plans.
 "One of the things that drives citizens crazy the most is not knowing what's 
going on in their neighborhood," he said. "If people can see what's happening 
and understand it, I think they wouldn't automatically say, 'Stop.' "
 Under the current system, Nutter said, far too many development decisions 
are made by the board of adjustment. That situation, he said, creates a level 
of 
uncertainty, unpredictability and delay that often frustrates both 
neighborhood groups and developers.
 With a new zoning code and master plan in place, he said, everyone involved 
would know what to expect. Fewer variances would be necessary, and minor ones 
could be granted by members of the Department of Licenses and Inspections 
without a board hearing.
 "Recent mayors have pursued unrelated transactions rather than following a 
plan," Nutter said. "We can no longer chase growth. Today, we need to guide it 
and manage it."

/The article is beyond belief.  I never talked to this person.  They 
have everything screwed up.  The hearing yesterday was before the city's 
Zoning Board.  It was never scheduled as a Spruce Hill meeting.  
Blackwell's office asked for a continuance at yesterday's hearing, and 
it was granted.  The new date is March 21st.  The DP staff simply cannot 
get straight the distinction between Spruce Hill zoning process and the 
city's operation, and I have explained it to them 10 times!  And I have 
no idea who Jared Miller is.  He and I have never had contact.  
Discussions are continuing between mosque representatives and the owners 
of the Rite Aid property, and we are waiting the outcome of those 
conversations./




actually, the dp article makes perfect sense.

both penn and shca need to astroturf the move of the liquor 
store, but they do it in their own way. for shca it means 
showing that the muslims and rite-aid are talking it over, 
that the city's zoning process is followed. for penn it 
means showing that shca is conducting community process, 
that community leaders support the move. and now we see what 
happens when one astroturfer becomes the other's astroturf. :-)

You misread the article.  It's Cedar Park Neighbors that has been  working on 
the 4900 block of Baltimore liquor store for years.  I assume  UCD thinks the 
move is a good thing, however, and for that reason I gather you  prefer the 
old store, which was so bad it made the Breshnev-era USSR seem cheery  and 
customer-friendly by comparison.

[UC] 4237-45 Walnut : Should a zoning variance be granted?

Personalities are detracting from the discussion.

The issue is not so much the kind of landlord Dan DeRitis can, should or
could be.
Or even how difficult or easy it would be to exchange the public face of
the Corporation that may be the real owner.

In the case of a Liquor store the biggest problems may stem from the
stock which will be stored at the property, and problems (traffic,
nuisance, drunk driving etc.) that may be caused by the consumers of the
products that the owner / tenant wants to sell out of the property.

It is the unpredictable third parties:
Desperate boozers looking for one bottle
Ambitious Gangsters ready to remove it all
Self deluded driving drinkers
Our neighborhood kids tempted to fake IDs
Those grasping at sobriety
Those morally opposed to any consumption of alcohol
and even 
Those enamored with the prospect of civilized service 
or better choice or
Those wishing to avoid vacant buildings in our midst

who should be considered, whether present in or absent from the debate.


The fact is that the land is currently zoned R-9.
This speaks of some intent to develop residences, perhaps an apartment
building.

The current variance is for Commercial use, as a Retail Pharmacy.
Arguably pharmacy's attract some of the same type's of 'medicators' that
Liquor Stores do, but in recent incarnations attract a mix that includes
grocery shoppers, seasonal decorators and folks in pursuit of beauty
supplies.
Asking for a change to liquor store is asking for a big change.

Under our current system, the landlord and proposed tenant should not be
shocked that they have to make convincing arguments for such a change.
And if granted, perhaps only after a negotiation that will improve the
properties in ways that will trade off for any inconveniences that the
changed zoning might create.
Agreements should be in writing and include things like:
improved lighting, 
landscaping, 
layout, 
driveway access/egress
before we, as a neighborhood, or our community associations, sign off on
either a variance or a zoning change.

The city is slow to record information.

These "First Monday" events are lovely.
The presentations are excellent, the Q&A sessions thoughtful and the
light repast charming.
And no one has ever "passed a hat".
St. Katherine was a Philly girl, and was active in homes and churches
like those so prominent in our Historic Street Car Suburb (she was born
in 1858 and died in 1955).
Her uncle, Anthony J. Drexel, was the founder of Drexel University.
Hopefully, this might be a topic that attracts some new attendees to the
Assumption series.

philanthropists Francis Anthony and Emma (Bouvier) Drexel. Taught from an
early age to use her wealth for the benefit of others; her parents even
opened their home to the poor several days each week. Katharine's older
sister Elizabeth founded a Pennsylvania trade school for orphans; her
younger sister founded a liberal arts and vocational school for poor
blacks in Virginia. Katharine nursed her mother through a fatal

1887, she asked Pope Leo XIII to send more missionaries to Wyoming for

aid to Indian missions, eventually spending millions of the family
fortune. Entered the novitiate of the Sisters of Mercy. Founded the

A handful of artists investigate what happens when you try to make things
with your own hands in the image of those things made by machines.  IKEA
"Billy" bookcases are re-imagined as "Philly" bookcases in a supreme effort
(right down to the hand-made particle board!) that surpasses any material
value (the glue alone costs more than the $49.99 that the bookcase costs)
and, potentially, any aesthetic value and goes directly toward process as
it's redemption. A photo booth becomes re-imagined as a drawing booth, with
live artists creating your portrait at the opening, along with a home-made
Tastycake test, a wooden stereo, rope, photocopies, and more...all made by
hand with spectacular results!

You misread the article.  It's Cedar Park Neighbors that has been 
working on the 4900 block of Baltimore liquor store for years.  I assume 
UCD thinks the move is a good thing, however, and for that reason I 
gather you prefer the old store, which was so bad it made the 
Breshnev-era USSR seem cheery and customer-friendly by comparison.



no, I didn't misread the article, but rather cited it as 
another example of the dp's astroturfing the liquor store move.

in the meantime, I have not expressed any preference one way 
or the other about where these liquor stores are located. if 
you think the old store is so bad perhaps you could get ucd

Please be advised that the final demolition of the remaining sections of
Pennsylvania Hall, at 3400 Civic Center Boulevard, is scheduled to occur on
Sunday, March 4th at 6:50 a.m.

Per City of Philadelphia guidelines, Controlled Demolition, Inc. advises all
persons to avoid this area, and if possible to remain indoors during the
event. 

PLEASE SHARE THIS INFORMATION WITH ALL OF YOUR RESPECTIVE CONSTITUENCIES.

EMERGENCY PERSONNEL:
For medical emergencies and those requiring access to HUP and CHOP,
Philadelphia Police will be on-site to direct individual personnel as
needed.

TRAFFIC PATTERNS:
Philadelphia Police will temporarily redirect local traffic before and after
this event.

The following road closures will occur at 6:30 a.m. and will be expected to
last until 7:30 a.m. (conditions permitting):

1) Spruce Street will be closed from the South Street Bridge to 38th Street;
traffic exiting from the Expressway at the South Street Bridge will be
directed eastbound toward center city.

2) Traffic exiting from the Expressway at University Avenue will be directed
toward Gray's Ferry Avenue (towards Philadelphia International Airport). 

3) 34th Street will be closed from Walnut to Spruce; Civic Center Boulevard
will be closed from Spruce Street to University Avenue.

4) University Avenue will be closed between Woodland Avenue and Grays Ferry
Avenue.

Road closure durations may vary, with Civic Center Boulevard being closed
for approximately one hour prior to the event and up to three hours after
the event. Bus and regional rail schedules may be delayed. 

University Ave is expected to remain closed up to 1 hour post implosion and
Civic Center Blvd. to remain closed up to 2 hours post implosion. If debris
is not significant, then street opening could be sooner than the above
listed times. All detours will remain in effect for these two streets until
the street areas are cleaned.

Zoning is difficult enough for a small nabe like this.  In other areas where 
development is determined by companies often run by people with a direct line 
to the mob, zoning can be the way to make small (and large) kingdoms for those 
who invest in various sized parcels of land.  I saw it happen every day when I 
attended zoning hearings in North Jersey back in the early and middle 80s.  
Although zoning may wear a different face today and certainly in a large city 
like Phila, I suspect it is still the major element in seeking control of the 
direction for any sized municipality.   

There is nothing simple about zoning other than as a way to control.

  Democratic mayoral candidate Michael Nutter said yesterday that he would 
reduce the role of the Zoning Board of Adjustment as part of his plan to 
modernize and rationalize zoning and planning in Philadelphia.
  At a news conference in Old City, Nutter proposed a thorough rewrite of the 
city's zoning code, which was last done in 1963. In addition, he would order a 
reinvigorated city planning commission to spend the next few years creating 
community master plans.
  "One of the things that drives citizens crazy the most is not knowing what's 
going on in their neighborhood," he said. "If people can see what's happening 
and understand it, I think they wouldn't automatically say, 'Stop.' "
  Under the current system, Nutter said, far too many development decisions are 
made by the board of adjustment. That situation, he said, creates a level of 
uncertainty, unpredictability and delay that often frustrates both neighborhood 
groups and developers.
  With a new zoning code and master plan in place, he said, everyone involved 
would know what to expect. Fewer variances would be necessary, and minor ones 
could be granted by members of the Department of Licenses and Inspections 
without a board hearing.
  "Recent mayors have pursued unrelated transactions rather than following a 
plan," Nutter said. "We can no longer chase growth. Today, we need to guide it 
and manage it."

There will be a total lunar eclipse tomorrow evening (Saturday) which will 
begin around 5:45 pm. The moon will be full and should already be over the 
horizon at that point.

Al,

Am I the only person who heard gunshots around 1:15a the other night?  Was it 
Wednesday?   It sounded like all hell breaking loose.  Sirens going off and a 
series of gunshots, in bunches of two, adding up to about 5, in between all the 
sirens wailing.  Then, as quickly as it came, the noise stopped.
