Re: [Videolib] Similar question - NBCLearn

2011-10-06 Thread Chris Lewis
We looked at it but not seriously. It's three times the cost of the
Vanderbilt TV News Archive. Vanderbilt includes footage from CNN, Fox,
and PBS too. NBC has at least two advantages over Vanderbilt - better
searching capabilities and an app that plugs into Blackboard. If
Vanderbilt got HEAVY use I might consider it but it's use is tepid at
best so adding 300% to the current price we pay for TV news archives
can't be justified.

[Videolib] it's anti-circumvention time!!

2011-10-06 Thread Carrie Russell
Libvidders:

I know it's hard to believe but already we must prepare for the
triennial 1201 rulemaking on circumvention of technological protection
measures employed by rights holders.

http://www.gpo.gov/fdsys/pkg/FR-2011-09-29/html/2011-25106.htm

For those new to the topic, here's a brief rundown.

Every three years, the Copyright Office (CO) conducts a "rulemaking"
which is a process initiated by a government agency to create or amend a
rule or regulation. This process generally begins with a chance for the
public to comment on the issue. ALA provides comments for a number of
Notices for Public Rulemakings.

When Congress drafted the DMCA they included a new chapter 12 of the
Copyright Act that talks about anti-circumvention of TPMs. It is a
violation to break a TPM to gain access to a protected work. Congress
asked that the CO to conduct a rulemaking to discover if this law
inferred with one's rights to exercise a fair use or some other
non-infringing use. A good example of this is that people with print
disabilities can circumvent e-books to enable text-to-speech
functionality. They have lawfully acquired the work but they can't use
it because of TPMs.

At the last rulemaking, it was determined by the Librarian of Congress
(under the recommendation of the CO and Commerce) that faculty in all
subject disciplines could break CSS on encrypted DVDs in order to make
clip compilations for instruction or research purposes. In addition,
college students enrolled in media or film studies could also circumvent
CSS to extract clips for educational purposes. ALA made this
recommendation based on a lot of feedback that we received from members
of video lib. (In fact, Gary Handman and Carlton Jackson testified).

This rule must be fought for again because the exemptions only last for
3 years.

I am collecting data on how this exemption has been working over the
last couple of years.

Do faculty at your institutions use clips in the classroom? Why?

Are faculty less worried about the legality of using clips in the
classroom?

Do you have examples of how the exemption helped an educator or student?

Currently this use is lawful so there is no reason to hide -- any
examples you send to me should include faculty name, discipline and
institution would be very helpful.

Some rights holders will argue that this exemption is no longer
necessary because now one can obtain movie clips through lawful services
on the Internet. Is this true? Do existing clip services meet faculty
needs?

I would appreciate any examples you could send my way via e-mail by
November 15th, 2011. Let me know if you have questions.

Many thanks!

-Carrie

Thanks, Gary. I'm leaning that way. I thought we had the equipment to go

Hi

My understanding is that after the copyright overhaul (1972), almost any
creative work set down in tangible form (written, filmed, etc.) is
defacto
protected under copyright. Now, in your case, things get sticky: the
"owner(s)" of this work would have to be determined. Is there
copyrighted
music used? Were there "performers"? (interviewees, etc.). What was
the
nature of "authorship" (were writers or others involved in creation?)
Was
the film a "work for hire"--in other words, was it made on the
university's nickel (in which case the institution may own it)

That said...if you get the faculty person's permission, what is the risk
of going digital. Pretty minimal, and you can always take the work down
if challenged.

(Also: I think the risk almost nil if you only stream this to
university
clients and not the greater world)

If it were ME, I'd do it.

Hello -
Have any of you subscribed to The Paley Center for Media's iCollection for
Colleges and Universities? If so, would be willing to share (off list) any
thoughts or insights related to your experience providing access to this
resource?

The content, which will continue to grow in volume, looks fantastic and has a
lot of potential for many researchers and students at my university.
Specifically, what I am looking for is some information about your experience
or feedback from users you have had regarding how the resource actually works
for them for their purposes. From my librarian's viewpoint, the interface and
functionality are a little frustrating - for example - advertisements that
played during a particular show are listed - but there are not any times of
when they played provided so it is difficult to find the actual commercials.
But maybe my concerns should take a backseat to content provision?

Thanks in advance!
Beth

Subject: [Videolib] Paley Center iCollection

Hello -
Have any of you subscribed to The Paley Center for Media's iCollection for
Colleges and Universities?

Beth

Re: [Videolib] Reserve situation with Karl Hess: Toward Liberty

2011-10-06 Thread Chris Drake
Thanks so much for the advice Gary and Jessica! The whole thing seemed
wrong to me in the first place but I hadn't even considered that the
professor didn't own the original film to make the VHS transfer to begin
with--I'll check with him on that. I made sure to tell him yesterday that
we aren't in the habit of placing copies with no written permission from the
copyright holder on reserve so he's already aware that we more than likely
won't be putting this on reserve.

I'll also see if I can contact the copyright holder regarding this--maybe
they'd want the content to get out there, you never know! Well, actually, I
made a general search yesterday and found the film on YouTube--where it had
been removed several times for copyright infringement--so I wouldn't tend to
doubt they'd rather people obtain the film and permission to transfer it
legally.

Thanks again for the help!

[Videolib] homemade movie copyright question

2011-10-06 Thread Jo Ann Reynolds
One of our faculty made a movie with his advisor in the 80's and wants
to digitize the 16mm film.

What are the copyright implications given others were involved in making
the film?

Is it enough that one of the original filmmakers involved wants to do
the conversion or does permission need to be sought for all involved?

How/is it different from print items as far as copyright goes?

Thanks,

NBCLearn http://highered.nbclearn.com is aggressively marketing their new

It has caught the eye and ear of some of ASU's higher ups... But I have
strong reservations about the $12K per year cost (tho I heard yesterday
that the cost is actually $18K per year!)

I think the Vanderbilt Television News Archive (if licensed) and NewsLook

What do others think?

Re: [Videolib] Reserve situation with Karl Hess: Toward Liberty

2011-10-06 Thread Jessica Rosner
It sounds like a film which is already doubly illegal. I am not even
clear where the original 16mm came from. Was it his copy or the
universities. Obviously one does not know the history but it certainly
SOUNDS like it was converted twice illegally. In order for it to even
pass the smell test you would need to know the origin of the 16mm, the
circumstances of it being converted to VHS ( was it degrading, was an
attempt made to contact the rights holder about a replacement,
something which you would then have to repeat with the VHS to DVD
transfer. Unless you have a detailed record of all of that the DVD is
basically a bootleg/pirate copy. Actually reading it again the copy is
100% illegal since it came directly from the professor who would have
had no legal right to make a transfer in the first place. Anything not
directly purchased by the copy MUST be an original copy ( it could be
used of course but it has to be original)

Read my lips: 10 grand a year! Every year!

I've been corresponding with the Paley re this collection re this over the
past few months. From what I can see, the collection is absolutely
fabulous (I've played around with beta access). But! Lordy! 10 grand a
year for single institutions!

I'm working on trying to get other UC campuses to buy in to a consortial
acquisition of this license, which would lower the price somewhat.

Looks like Karl Hess was originally distributed by Direct Cinema in Santa
Monica, CA, but is no longer in their catalog.

In any case, sounds to me as if the copy in hand is illegal and, if t'were
me, I definitely would not accept it on reserve. Beyond that using an
illegal copy of a film to show in class is never a good idea.

You should contact Direct Cinema regarding possible subsequent
distributors or get the filmmaker's address.

Re: [Videolib] Question about Latin American and Spanish

2011-10-06 Thread Amy Aquilino
Hi Natalia,

Women Make Movies has several titles you may find interesting in our
Latina Studies collection found here:
http://www.wmm.com/filmcatalog/collect10.shtml

We also have a new release I highly recommend titled, Ella es el
Matador. Here is a synopsis:

For Spaniards-and for the world-nothing has expressed their country's
traditionally rigid gender roles more powerfully than the image of the
male matador. So sacred was the bullfighter's masculinity to Spanish
identity that a 1908 law barred women from the sport.

Visually stunning and beautifully crafted, ELLA ES EL MATADOR (She is
the Matador) reveals the surprising history of the women who made such a
law necessary, and offers fascinating profiles of two female matadors
currently in the arena, the acclaimed Maripaz Vega and neophyte Eva
Florencia. These women are gender pioneers by necessity, confronting
both bull and social code. But what emerges through this mesmerizing
film is their truest motivation-a sheer passion for bullfighting, in the
pursuit of a dream.

[Videolib] Reserve situation with Karl Hess: Toward Liberty

2011-10-06 Thread Chris Drake
I've had an interesting situation arise with a reserve "video" this
quarter. Our usual policy is that we do not accept copies (meaning someone
burned their own copy of a commercial video) of copyrighted material just as
we also do not accept rental videos for placement on reserve.

A professor just gave us his own DVD copy of Karl Hess: Toward Liberty
which he had made from a VHS which was a film transfer of the original
film. I've checked around and can not find any copies of the film available
on VHS or DVD (and since our IT department took over all the AV campus
support from me they threw out all the film projectors) so I would say that
he is somewhat covered to use the video in class himself but I'm still very
iffy about putting the copied DVD on reserve.

Anyone have advice on this? My gut tells me not to do it but I honestly am
not sure since the title is not available in any other format that we could
reasonably be expected to attempt to use...though I think that "protection"
is only for classroom use (thought I might be wrong and that's why I'm
asking.)

Thanks so much!
