[Videolib] BBC Proposes Downloading Service (Jeremy Wilcox)

Hi All

As some of you will know, I represent BBC Active Video for Learning, the
educational joint-venture between Pearson and BBC Worldwide in the UK.

I thought I'd drop a note on here regarding the interesting news from
the BBC about Project Barcelona, which proposes to open up the BBC
archive for the purpose of paid-for downloads.

My understanding is that, upon approval, this will be a UK-only service,
available to licence fee payers. If successful, I'm sure there would be
moves to commercialise it internationally but because of existing rights
arrangements it is difficult to see how this would be into educational
markets.

The correct path for North American educational rights to BBC programmes
is and will remain via our service (www.bbcactivevideoforlearning.com)
and that of our well-known authorised educational distributors in the
region.

I was interested to see the comment from Randal that a lot of BBC
programming is not available in the US. At a consumer level this might
be true but for education we, or our distributors, can provide huge
swathes of the factual BBC archive for teaching use. 

We have a large listing of BBC programming and we operate as the gateway
to the archive for anything which isn't listed too - and we'd love to
hear from you!

Greetings Media Librarians,

The Notable Videos for Adults Committee has three vacancies to fill this

year. We aim for a balanced mix of librarians from academic, public and 
special libraries that work with media and serve adult populations.  We 
are looking for three librarians from an academic, special, or public 
library to balance out the team.

This is an opportunity to serve on a rewarding and enjoyable 
professional committee at the national level. Members of the committee 
must be members of the American Library Association (ALA) and the Video 
Round Table (VRT). Please note that representatives or employees of 
video producers or distributors are not eligible to serve.

Each member will serve a term of two years, with a maximum number of 
consecutive terms not to exceed two, for a total of four years of
service.

All committee members are required to:

*  Be members of ALA and the Video Round Table (VRT),

*  Attend ALA Midwinter for two consecut

Deg and Chris,

We put our PPR statement in the 540 field so if patrons do a keyword search for 
"public performance rights" they'll find any title that has it.  

In terms of promoting the videos that have PPR, in my experience it's hardly 
ever those videos that people want to screen.  Which makes it all the harder 
having to pay for it.  I'm so glad for distributors who are willing/able to 
sell without PPR.

I had the opposite reaction, assuming this would preclude me from buying at
the individual rate as we have been, e.g. Menschenfrauen for $19.95.  There
are too few students and inadequate bandwidth at my college to make
streaming a desirable or viable option.  And we don't need PPR because we
are very strict about only allowing viewing permitted under fair use and
TEACH.

And on principle, as a builder of library collections, I want to purchase,
not license, what I pay for.  Remember once you agree to a license, you've
relinquished your rights under copyright law.

Well, isn't this basically the same deal as other streaming:  if it works
for your institution in terms of cost-effectiveness and general utility,
it works.  If not, not...stick with the DVD.

I must say that the current FACETS list of titles available for streaming
license is limited...but I understand that it's gonna grow.

We're already deep into licensing print content (remember journals?)...I
balk at term licensing, because it pisses me off to buy the same title
every 3-5 years.  On the other hand, the ability to acquire a heavily-used
title for streaming in-perpetuity is pretty damn cool...even at $500.

We're good as long as Facets allows us to continue buying the "individual"
DVD.  See the Menschenfrauen page as an example where one might be steered
towards selecting one of the Educational Options because some vendors
insist that we cannot purchase without PPR.  btw when we ordered
Menschenfrauen there was no Educational Option.

I get a little concerned when distributors offer lifetime rights on
what I would describe as standard feature films, especially foreign
ones. I have been working with Flicker Alley to offer their titles
with lifetime streaming rights and while they are able to do this with
many, but not all of their silent films, it will rarely work when
major or even  minor rights holders outside the US (as well as ones in
the US) are involved. Before buying anything with lifetime rights I
would make sure the seller certifies that have a contract with the
rights holder that specifically allows them to do it. You do not want
a rights holder coming back and telling that the company was not
entitled to sell those rights. I believe sometimes this is a matter of
interpretation, but I feel strongly that unless a rights holder
specifically agrees to such sales by contract, bad things can happen
in the future. Any rights holder with sense would agree, but foreign
rights holder in particular seem allergic to the concept of lifetime
rights. I think Facets has some special relationships with particular
filmmakers, but it is a problem for the vast majority of feature films
not owned by studios ( they clearly have rights on most of their
titles but I don't see them offering lifetime streaming right any time
soon).

I don't mean to go too "inside baseball" on everyone but since this is
basically a very new type of rights not previously included in
existing contracts, I would just be careful to make sure there is
written agreement ( even if it is just an email) between rights
holders and distributors to sell lifetime rights.

A lot of people ask me if Zeitgeist can sell them perpetual streaming/ 
digital site rights and the answer is "no" for the very reasons  
Jessica mentioned.


We have not negotiated lifetime rights for any of our titles and  
therefore cannot offer lifetime rights, streaming or otherwise to  
buyers.


We DO sell DVDs with public performance rights and those rights are  
good for the life of the disc. But we feel comfortable giving these  
out as the material will eventually deteriorate and we are not  
guaranteeing anything in perpetuity.


I'm not going to judge or try to expose other companies who operate in  
a similar manner to Zeitgeist (distributing feature theatrical films)  
that are attempting to sell these rights - but as per Jessica's note I  
would be a little wary.


If they negotiate contracts in a similar manner to us than there is  
absolutely nothing in these contracts stating that we/they can sell  
perpetual streaming or digital site licenses to institutions as of  
yet. I imagine most rights holders would balk at reading something  
like that in a contract but then again, we've also never attempted to  
put that in. Maybe other companies have.


If and when we DO put something like that in our contract for one of  
our titles I will advertise as much.

For things sold at a retail/ individual price I agree you should only
have to purchase rights you actually need, however with the position
of some institutions that they don't need any rights to stream
complete feature works the issue becomes complicated. I believe that
for "educational" films for which home use copies are either not sold
or
whose sales are 100% controlled by the distributor ( as in no third
party sales like Amazon, Action Media etc.) distributors should in
fact absolutely require purchasers to agree in writing that unless
streaming rights are purchased the film can not be streamed.
