H, Well Requiem for a Dream starts out with a fake infomercial - it's part of the plot. It's odd that you can't skip to the next chapter though - is this what is occurring? Also - I know some DVDs do not have a "Play" function per say but you just play it from the first chapter. Elizabeth, I'm sorry you know I love Kino and appreciate all that you do but we simply disagree on this (relatively small) issue. What you just said implies that we are only in the business of generating immediate profit for rights holders regardless of the future implications or even our contractual obligations. I can't reconcile that. Zeitgeist is not exclusively in the business of selling to educational institutions and it's not my job to offer rights that we don't have simply because a customer would like that option available. We sell our films on iTUNES for personal use, not educational exhibition. It's a completely different section in the contract. All kinds of digital streaming sites - Netflix, Amazon, etc. work just fine with termination dates. I don't see why libraries can't do the same AT LEAST until we work out the language in our contracts that allows us to do this with full disclosure to the rights holders. If we were just an educational company buying lifetime rights would be a different story. But the pedigree and universality of films that both Zeitgeist and Kino distribute, in my opinion, require careful consideration about which rights we attach to our packages in accordance with our contracts with sales agents. But I have no doubt you've given this careful consideration on your end and have come to your decision as I have come to mine and we will just have to see what the future holds. Since again I have been explicitly told by several major overseas rights holders that their contract do not include this I think it would be unfair to have institutions in the middle. Frankly there have in fact been a number of cases in which after a contract expired a rights holder told an institution that a distributor had no rights to sell a particular item with lifetime PPR and they insisted that showings be cancelled and the film never shown. It is not common because most large overseas companies have little knowledge or interest in such things but again this should be between distributors and rights holders. A lot of people ask me if Zeitgeist can sell them perpetual streaming/ digital site rights and the answer is "no" for the very reasons Jessica mentioned. We have not negotiated lifetime rights for any of our titles and therefore cannot offer lifetime rights, streaming or otherwise to buyers. We DO sell DVDs with public performance rights and those rights are good for the life of the disc. But we feel comfortable giving these out as the material will eventually deteriorate and we are not guaranteeing anything in perpetuity. I'm not going to judge or try to expose other companies who operate in a similar manner to Zeitgeist (distributing feature theatrical films) that are attempting to sell these rights - but as per Jessica's note I would be a little wary. If they negotiate contracts in a similar manner to us than there is absolutely nothing in these contracts stating that we/they can sell perpetual streaming or digital site licenses to institutions as of yet. I imagine most rights holders would balk at reading something like that in a contract but then again, we've also never attempted to put that in. Maybe other companies have. If and when we DO put something like that in our contract for one of our titles I will advertise as much. I am sure distributors are trying to get lifetime streaming rights but other than studios and directors I just don't see a lot of rights holders agreeing. It is likely easier with non fiction films or at least that has been my experience so far. It is going to be a bumpy ride as rights, new distribution methods and copyright laws are posing a lot of new questions and opportunities. Hi Jennifer, The film is absolutely not legitimately distributed through the sites that you mentioned. I know that it appears on youtube from time to time but we do try to take it down as fast as possible, I also know we have a clip on megavideo but I was unaware and unable to access a full version of the film on that site, but maybe you have to be a member. It's very hard for me to track and take down all illegal streams for Zeitgeist but I do try my best. I know Examined Life is one title that gets thrown up a lot. But thank you for pointing this out to me and I will try my best to get this down any conceivable way I can. You also might want to inform the instructor that it is fairly unethical and (ironically) against the content of the film she is having her students watch, to suggest that they go to a legally questionable uploading site for their coursework. At Zeitgeist we try (as best we can) to find a middle ground. It's $139 for public schools and libraries (and other special cases) and $195 for private institutions. Plus, they come with BOTH a 3-year streaming license and PPR. I know that's still not doable for some librarians and I understand. But because we distribute a lot of activist films, and most of them need to recoup their initial investments, I try my best to sell them at that price. Also, I offer FREE replacements on all of Zeitgeist DVDs that are damaged. Ask anybody. It's funny, I just rejected an offer from Amazon to do something similar. Not only does it defeat the purpose of having a non-theatrical relationship with the consumer it's also giving a vendor like Amazon the right to sell and discount PPR which is something I'm not comfortable with at all. But are you telling me that this distributor on Amazon is not even announcing that these titles come with PPR? They're just blatantly telling organizations that this is the price the have to buy it at? As long as I'm snowed in my office I have to say that's crap. Just FYI I've never coerced a teacher or librarian into saying they NEED to buy PPR with our DVDs. But have explained that if student groups would like to take it out and hold their own screenings with our films then it's definitely a good idea! (I know different libraries have radically different policies on this) I had a teacher come to me yesterday telling me her librarian said she needed a public license to show Manufactured Landscapes in her classroom as part of her course. I told her to tell the librarian to review the DMCA. I don't think it's wrong for us to sell DVDs a two different prices. A lot of non-library groups I sell to like churches, YMCAs, JCCs, non-profits, community groups etc. like the editions with PPR because then they don't have to come back to me every time they want to put on a free public screening. I often even adjust the PPR and price according to what the group needs. But that's never something Amazon should get involved in. Yes at one point in time we had Where Is the Friend's Home, And Life Goes On, and Close-Up but the prints (I'm 90% sure) went back to Mongrel (the Canadian company) after we lost them. All we have now is 10 and 10 on 10.
