This is a nice option because it is pro-active and community driven. There are now 7 people on the location committee: Itzik (WMIL), Ilario (WMCH/IT), Arnaugir (Amical), Osmar (WMAR) from the affiliations plus Asaf (WMF), Bence (AffCom), Mike (FDC). Thanks to all of you to step up for this important task! After the comittee has decided about the hosting organisation (by 15 October) we should all continue with defining the goals and desired outcomes and work on the programme together. You can read the opposition filing in the documents section of the EU trademark application[1]. Additionally, an opposition observation has been filed but it is not yet available to the public at the URL mentioned above; our limited understanding is that it will be published there in the coming days. We’ll keep everyone informed on this aspect. So what is next? The OHIM will now review the Notice of Opposition to determine that the opposition is admissible. This takes a few weeks. If the notice of opposition is found to be admissible, the 'cooling-off period' commences.[2] The 'cooling-off period' allows the parties can either negotiate an agreement, and either party may withdraw their claim to the mark without incurring additional costs. This period lasts between two months and two years. It is important that everyone understands that there is no need to act hastily. If the WMF and community need time to find the right solution, we will have two years. The WMF set the timetable by applying for this trademark, and they have not withdrawn that application or responded appropriately to community calls for this to be re-evaluated. The WMF was informed in March that we viewed the trademark registration as unacceptable. Even after our announcement on September 21, the WMF has not addressed the heart of the issue; they have chosen to focus the community attention on a new approach, a collective trademark, rather than consider the erosion of the Commons by their trademarking of a public domain logo against the intentions of the author of the logo. Contrary to the WMF’s claims on their ‘Request for consultation’[3], we have never said that the opposition needed to be filed on September 23. We are aware that we could have delayed the opposition until December. As the opposition process is able to proceed through the non-adversarial phase for two years, we believe it is appropriate that a properly focused formal process should commence now. During the first two months of the cooling-off period, we request that the WMF provides a brief to the community explaining why they believe they have a legal claim to the community logo, given that the board knew it was selected in order that the community did not need to request authorisation.[4] We also encourage the WMF to publish their research on collective trademarks, so that the community can make an informed decision about the utility of this approach. It is our understanding that, in the EU at least, the WMF will need to abandon their current trademark registration if they are to apply for a collective trademark. What is your own perception of the criticism (particularly on Wikidag 2013) and critics? Some our (WMUA) Board members tend to treat criticism as their 'demotivation', 'trolling to distract from creativeproductive work', even 'shooting into the head from behind' etc. What about that in WMDK? Please feel free to continue your participation there, since all issues continue to remain open for discussion.[1] We would also like to invite community members to join the ongoing discussion regarding the trademark protection of the Community logo that we posted on Monday: https://meta.wikimedia.org/wiki/Community_Logo/Request_for_consultation. Our goal is to obtain clear direction from the community on how we should proceed with respect to the registration of the Community logo and whether we should pursue a collective membership mark for the community. Our current consultation is part of an ongoing discussion regarding this logo. We joined this discussion on the talk page for the Community logo and Wikimedia thematic organizations.[2] We then initiated a broader discussion on trademarks in June, where the discussion on the Community logo continued.[1] That trademark practice discussion remains open and active, and we have been responding to a wide array of important issues thanks to community comments. We were first notified this weekend of a potential opposition to the trademark registration,[3] a proposal not raised earlier in the community consultation on trademark practices even though the deadline for the opposition was not until December 22. We accordingly initiated a community consultation on Monday about how you would like us to handle this.[4] Indeed, this is consistent with the legal team’s ongoing efforts over the last two years to include the community in important legal decisions and policy proposals. We have put a strong emphasis on a close working relationship with the community, such as in our discussions on the Terms of Use, the Privacy Policy, the Conflict of Interest Guidelines, the Legal Fees Assistance Program, the Political Affiliation Policy, and now the Trademark Policy.[5] In our ongoing consultation regarding the Community logo, we have asked the community to let us know whether to seek a collective membership mark (which will help maintain protection against misuse by others, while allowing free use by community members) or to abandon the registration of the trademark and its protection by WMF.[4] Collective membership mark is an idea that we started researching a couple of months ago in light of community comments in the trademarks discussion. To be clear, we have no emotional investment in the outcome. This consultation is the community's opportunity to let us know how the mark should or should not be protected. As we stated before, we are fine abandoning the trademark registration to put our limited resources against other priorities, but this decision belongs to you and the Board [6]. Please feel free to continue your participation there, since all issues continue to remain open for discussion.[1] We would also like to invite community members to join the ongoing discussion regarding the trademark protection of the Community logo that we posted on Monday: https://meta.wikimedia.org/wiki/Community_Logo/Request_for_consultation. Our goal is to obtain clear direction from the community on how we should proceed with respect to the registration of the Community logo and whether we should pursue a collective membership mark for the community. Our current consultation is part of an ongoing discussion regarding this logo. We joined this discussion on the talk page for the Community logo and Wikimedia thematic organizations.[2] We then initiated a broader discussion on trademarks in June, where the discussion on the Community logo continued.[1] That trademark practice discussion remains open and active, and we have been responding to a wide array of important issues thanks to community comments. We were first notified this weekend of a potential opposition to the trademark registration,[3] an issue not raised earlier in the community consultation on trademark practices even though the deadline for the opposition was not until December 22. We accordingly initiated a community consultation on Monday about how you would like us to handle this.[4] Indeed, this is consistent with the legal team’s ongoing efforts over the last two years to include the community in important legal decisions and policy proposals. We have put a strong emphasis on a close working relationship with the community, such as in our discussions on the Terms of Use, the Privacy Policy, the Conflict of Interest Guidelines, the Legal Fees Assistance Program, the Political Affiliation Policy, and now the Trademark Policy.[5] In our ongoing consultation regarding the Community logo, we have asked the community to let us know whether to seek a collective membership mark (which will help maintain protection against misuse by others, while allowing free use by community members) or to abandon the registration of the trademark and its protection by WMF.[4] Collective membership mark is an idea that we started researching a couple of months ago in light of community comments in the trademarks discussion and had planned to present it after finishing the research. To be clear, we have no emotional investment in the outcome. This consultation is the community's opportunity to let us know how the mark should or should not be protected. As we stated before, we are fine abandoning the trademark registration to put our limited resources against other priorities, but this decision belongs to you and the Board [6]. To ensure full community participation, we have invited users from all across the world to take part in this and continue to encourage that.[4] Our actions will be based on the community consultation underway and the Board, not on an extra-community legal action. We understand that an opposition against the Community logo trademark has been filed, and we will handle it as we do all litigation. The litigation deadlines are a non-issue to us because we will do what the community and Board tell us. Our goal is to determine the broader community intent through a community consultation that is open to everyone. If the community and Board tell us that we should abandon registration, we will do so; if you want it protected, let us know.
