I have been active on Wikimedia projects since December 2002, I am a member

I also spent nearly 10 years of my life in India, where I have been active
with several NGOs, and I am fluent in Hindi.
So I have a deep knowledge of Wikimedia projects, Wikimedia Chapters, and
social and cultural situation of India.

There is a discussion on Commons about the copyright law of India,
precisely whether pictures taken prior 1957 should apply the new law
or the old law. I believe it is the later, but Carl Lindberg, says
there is a uncertainty.

Could WM India ask a lawyer for a confirmation.

[Wikimediaindia-l] License and copyright for Indian government documents

Following this [1] discussion, it appears that the conditions into which
some documents are released by the Indian government are nearly the same as
CC-BY. However some people on Commons think that we need a confirmation.

Could the WM India ask whether the conditions specified here [2] are
compatible with such a license (or another free license)?

More precisely the requirement that images such be "Reproduced accurately"
is a moral rights clause -- a reproduction should not be modified to
misrepresent what the original work was. The rest of that clause also gives
a hint they are referring more to moral rights, as Carl Lindberg said.

[Wikimediaindia-l] Membership

I read that Wikimedia India does not accept member who are not Indian
nationals.
This comes as a big surprise, and I don't see any reason for it.
As far as I know, membership in a non-profit in India is not limited to
Indian nationals.

A change whould be most welcomed.

which cannot be hosted on Wikimedia servers. I think this solution
should gather more support.

Yes, this is a huge problem for Indian content hosted on Wikimedia
servers, and not only for Wikisource, but also for pictures, movies,
sounds, etc. hosted on Wikimedia Commons.

There were quite a few famous images of Mahatma Gandhi deleted for this reason.

[Wikimediaindia-l] [Wiki Loves Monuments] URGENT: A few things to do

It seems that time is running short, and we are not yet ready.
There are a few things which are still not clear to me:
* What are accepted monuments for the competition? If only these
mentioned by ASI, the list is really incomplete and a lot are missing.
* I think the list should be copied to Commons, as not all
participants use English Wikipedia.
* Who are the jury members?
* State Level Coordinator for Delhi and Keral are still missing. What
about other states? (only 6 are in this list)
* Program Team is half empty.
* Some more information about what is acceptable is needed.

First, all images there might not have an educational value. Then

What do we do in this case? How do we attribute an ID number?

Another issue will be getting the connection and time to upload all images.
With my 3G key, it takes 20 to 30 minutes to upload a full size JPEG
image (24 Mpx, 8 to 12 MB). I usually resize image to 12 Mpx which the
volume from 6 to 8 MB. Still it takes ages to upload HR images. During
the WLM contest, I could take 100s of usefull images, but I could
never upload them all. Has anyone an idea how to overcome the problem?

[Wikimediaindia-l] Museums access for photographers

I would like to document the Calico Museum of Textiles in Ahmedabad
[1][2], one of the greatest textile museum in the world, but
photography is currently forbidden there.
There is currently nothing on Wikimedia Commons about it.
Maybe a formal request from Wikimedia India may help getting a permission.
Several days will be necessary, as the museum is pretty big.
Permission to use a tripod is also necessary.

For your information, Wikilivres hosting service provider received a
letter from Gallimard, a leading French publisher.

This letter says that major French ISPs have been asked to restrained
access to a list of pages.
Then the hosting service provider sent me a mail saying that "terms of
services have been violated",
and that there are "monitoring" the site.
In addition, the letter sent to French ISPs is one year old, and the
restriction has never been applied
by any provider, according to the tests I have made.
However these restrictions should have been done "within one month",
according to this letter.
Actually there is nothing in French law which demands ISP to restrict
access to content
which are not in the public domain in France.

AFAIK no terms of service was violated, and I've asked the ISP for
clarification.
Gallimard issued a similar threath to Wikisource last year, after
which some texts were deleted by OFFICE action, and later restored
after I sent a counter-notice. There was no news from Gallimard after
that.

This is to mention that copyright has to be taken seriously in this project.

I see several possibilities:

1. Free hosting. I think that an educational instution (e.g.
University) might accept hosting Wikilivres under some conditions
(legal responsibility from a Wikimedia chapter?).

2. Financial support only. I could continue to have the legal
responsibility of the project. I have a Paypal account to receive
donations.

3. A chapter or another organisation takes over the legal and
financial responsibility.

My main criteria is the long term support for the project.

Wikilivres is currently hosted on a small dedicated server in Montreal, Canada.
It follows the Canadian copyright law, in which a work is in the
public domain 50 years after the author's death.
It costs 74 US$ monthly, or about 3,500 Rs. at the current rate.
Pathoschild has helped me recently for upgrading Mediawiki to new versions.
I am open to proposals regarding a takeover.

A review of the content and a policy about inclusions seem to be
sensible if the legal responsibility is moved on.
Some of the content is under a non commercial license [1]. This could
be moved somewhere else (Wikia?), as it needs not be hosted in a
particular place. There are a few personal essays with a free license,
which would not be accepted on Wikisource, as they were not previously
published (Wikia also?). They are also a few French articles from
Wikipedia [2].

Canadian law says that what is PD elsewhere is also PD in Canada (law
of shorter term).
Canadian law is 50 years pma, while Indian law is 60 years pma, except
for photographs.

are not willing to push the legal envelope to discover the limits of
the law; it's easier to misinterpret to one's own disadvantage.
Corporate interests have no such scruples. Too many WP admins are
overly willing to impose their ignorance out of an oversensitive
concern for the project's safety. Some open access purists are a
danger to themselves."

It is totally insane to require users to do this in order to publish a
photo on Commons.
Commons needs to assume good faith from editors.

The point is that in most cases, it is not possible to prove anything.
In copyright law, like in all legal issues, the proof is usually on
the accusation.
In Commons, it is reversed, the proof is on the uploader, which s/he
cannot do in many cases of Hindu paintings. Thus the system is skewed.

Well, there are several problems with that.

1. In order to make good photographs, a tripod will be necessary. I
doubt they will allow that for the usual fees.

2. Seeing the size of the museum, many days will be needed to take
good photographs (not snapshots) of a sizeable portion of the museum.
At 300 Rs. each, it would be expensive for me. Actually I might not
need to pay that much, as I am a resident in India, and I am entitled
to the Indian fees.

3. For some items, there might copyright issues to publish the
resulting images under a free license.

[Wikimediaindia-l] National Museum in Delhi

Hello,

I visited the National Museum in Delhi today and I have discovered
that it contains a huge collection of arts which would be very
interesting to have in Wikimedia Commons. I have a decent camera and a
tripod, and I could spend some time taking photographs there, if the
museum would allow.
Would it be possible to contact them officially, either Hisham or
someone from Wikimedia India?

I am not an OTRS volunteer, but in April 2010 I got a real threat
because of my work on Wikisource.

Gallimard, one of the biggest and most famous French publisher, sent
me a registered letter (yes, here in India!) threatening to sue me if
the texts it claims a copyright on were not quickly deleted. It also
sent the same to the Wikimedia Foundation. The texts were deleted
after a request by Mike Godwin, WMF lawyer. I made a counter-notice
and the texts were undeleted in June 2010. Gallimard found my IRL
address on Facebook, as I have a link to my Facebook profile on my
Wikisource home page.

The deleted texts are copyrighted in France, but not in USA, and not
in India, so there are legally hosted by the WMF in USA, and I am
legally entitled to publish them on Wikisource, as a resident in
India.

In fact, I expected Gallimard to try to sue me in France, which would
not have much real effect on Wikisource, but would be quite annoying
for me if I go back to France. But I never received any news from the
publisher after I sent them a letter saying that they business model
is outdated, and they should find better way to promote French
literature.

I don't know about Sinhala, but there is free font for Indian
languages, including Gujarati which is called Lohit
{Bengali|Gujarati|Hindi|Kannada|Oriya|Punjabi||Tamil|Telugu}.
