Depends...

You have to prove that you returned your IPs. That could be as easy as a 
letter or copying a letter previously sent to your upstream to request the 
SWIP infor removal, or having none of the IPs on the block responding to 
Pings.
Or showing that your BGP routers or ASN are no longer advertizing routes for 
those IPs.

You are not responsible for whether your upstream is responsible.
But again, it boils down to proof, and whats the easiest approach to get 
results.
With ARIN, to speed the process, you dot all your Is and cross all your Ts, 
because ARIN is overly zealous about formalities.

[WISPA] IP Space WHOIS Data Update

We have returned some IP space to our upstream few days ago.  How long
does it typically take for them to update the WHOIS data so it no
longer points to us?

Well, That's assuming that they update the Global WHOIS info for it ASAP. 
Once they update it, It takes about 24 hours (changes are seen in about an 
hour normally).
I know we returned some space back to TW Telecom years ago that is still 
SWIP'd to us. Still trying to get them to undo that...

We had space registered with Qwest for years even though we gave it
back.  As long as you let ARIN know that the space is in your name but
that you are not using it, it will be fine.  ARIN is usually pretty good
to work with.

Make sure to address this in the notes when you ask for additional IP Space.   
Simply put - let them know that you have requested on (list the dates) for the 
IP Space to be swipped back to the original provider and they have failed to 
complete the task.
Also note that you are worried about this causing issues w/ your new request.   
In short - it always helps to give them a heads up.
