Mumbai: The high court on Tuesday directed the <https://timesofindia.indiatimes.com/topic/Union-government> Union government to clarify if students with <https://timesofindia.indiatimes.com/topic/learning-disability> learning disability were entitled to <https://timesofindia.indiatimes.com/topic/admission-to-MBBS> admission to MBBS seats reserved for <https://timesofindia.indiatimes.com/topic/persons-with-disabilities> persons with disabilities. A division bench of Justices Naresh Patil and Girish Kulkarni has given the Centre a day's time to respond and scheduled the matter for further hearing on Wednesday. The court was hearing petitions filed by candidates challenging a notification by the Medical Council of India that disqualified candidates with learning disability from availing of reservation under the category for disabled persons. "It is important to ensure genuine students are given benefit of the rules," said the judges. The petitioners who suffering from Learning Disability of Dyslexia, Dyscalculia and Dysgraphia had appeared for NEET under the persons with disability category of 'Intellectual Disability'. In January 2018, the MCI had held that candidates suffering from disabilities as prescribed under said Disabilities Act were be eligible for MBBS under the disability quota. Later in June, the MCI prescribed that "candidates suffering from Learning Disability would be deemed fit to pursue MBBS course, however, they will not be eligible to claim benefit under reservation of person with disability category". The petitions claimed that the change of rules in the middle of the admission process was arbitrary and illegal.
