I experienced the same type of issue, it turned out that the patch needs to be run by whatever user owns the files. We run our system under a certain account and so the owner of all the Remedy files are owned by that owner. I was running the CMDB patch as root and it failed with a very similar error. BMC support told me to run it as the owner and then the patch applied correctly. Supposedly this is "fixed" in CMDB 7.6
