this situation. When i prefix 1# the call then arrives at CME with 1#4210
which allows me to match a different incoming dial-peer with g729, then i

Calls to CME phones via GK would likely be G729. These work fine.

Does it have an extension assigned? Unlike SCCP, SIP phones won't register
unless they have an extension assigned.
