This statement is presented in English and in Bahasa Indonesia. English: Your Excellency, I am writing this statement on behalf of Internet Society Indonesian Chapter, as officially elected secretary, and registered in Internet Society International as member number 1347822. Internet Society Indonesian Chapter is a chartered branch of Internet Society International, while Internet Society International is the home organization for Internet Engineering Task Force and other working groups on the internet. In this matter, our chapter is acting upon request and on behalf of the registrants of hundreds of domain names falling within the scope of ccTLD .id (the list of all domain names we represent is included). It has become a great grieve and concern to us that the state and continuity of the management of service of all ccTLD .id domain is currently under a serious threat. The recent move by APJII to push for the installation of an entirely new organization to manage the service, event though still within the limits of the law, has been done in a reckless manner, and has bring about the situation today, that seriously jeopardize both the fate of many commercial businesses (example: lionair.co.id), and official government business (example: bi.go.id and depkominfo.go.id) In viewing a matter of such great proportion, we implore Your Excellency to take a moment to imagine, what would happen if the access to all of these domain becomes unavailable, even only for 24 hours. While it it safe to assume that installation of a new system may becomes fully life within 48 to 72 hours, the cost to the reputation of the businesses, and the cost to our reputation as a country will be severely damaged and can take years to recover. (example: even now people still laugh at how the Microsoft passport service becomes inaccessible for 24 hour because nobody remember to extend the domain) We therefore would like to point out that at the root of this problem, lies the one virtue that has become the absolute foundation of any successful management and government, and that virtue is Trust. The community trust Your Excellency, and that is why suggestion were made for Your Excellency to assume control of management during the so called "transition period". But Trust, Your Excellency, is earned and not given, and it is quite apparent that APJII as the initiator of the change, has not earned Trust from the community (we stress the fact that no one outside APJII has seen even partial draft of the bylaws of this new organization said to be "ready to take over"). In this matter, we do not refer to any individual Internet Service Provider, because we are quite assured that they are trusted by their subscribers. Instead, we refer to APJII as an entity, and to be exact, the persons representing APJII in this matter. As your excellency may have been informed, the present manager of ccTLD .id has refused to hand over the management application to the new organization, however, this is not an accurate information. The truth is, the application currently used by the present manager is the intellectual property right of several members of the community, which has been loaned to Mr Budi Rahardjo personally. Therefore, the application may not be transferred without explicit agreement from the owners of the intellectual property rights, and quite frankly, they are currently in the position of refusing to let anyone else using it. If permission is to be obtained by force, we fear that it will create bigger chaos in the industry, renewing the branding "pirate" over us, that we have so earnestly try to remove this past few years. Because Internet Society and its chapters are mostly interested in the growth and continuity of the internet in the world, our chapter has attempted to bridge the difference between APJII and the community. Alas, until this date, our official inquiry has went unanswered and therefore, we cannot proceed any further in this course. We have however, secure the fact that the primary cause of objection from the community is because the registrants has not been allowed to have a say in this matter. In relation to this, we again implore Your Excellency to consider the fact that the sole reason that the management exist, is to serve the registrants, therefore it is the registrants who should tell management how they wish their domain is managed, and not the other way around, especially not from other organizations having vested interests. Once we have agree in this, we are certain that Your Excellency can see that the solution in this matter is quite simple, and here is the solution proposed by the registrants, as the real stakeholders of this matter: "That any proposed change to the currently operating management of ccTLD .id , must first be presented in full to all registrants of .id domains, and sufficient time must be allowed for in depth discussion regarding the positive and negative effects of such change. Furthermore, no change should take place unless officially approved in a vote representing no less than 50 % + 1 of all registrants." We have been given positive indications, that if this proposed solution is warranted, then service can resume as usual, and if any organizations is approved by the registrants to take over the management of their domain, hand over will commence smoothly and the owners of the above said intellectual property will gladly extend the loan of the application program to the new managers. At the end of this statement, we would like to express our high hope in the wisdom of Your Excellency, and we believe that Your Excellency will agree that our proposal is in line with the Transparancy and Democracy program, as declared by His Excellency President of The Republic of Indonesia Bahasa Indonesia Yang Terhormat Bapak Menteri, Saya menulis pernyataan ini mewakili Internet Society Indonesian Chapter, sebagai sekretaris resmi terpilih, dan terdaftar di Internet Society International sebagai anggota nomor1347822. Telah menjadi kepedihan dan kekhawatiran besar bagi kami bahwa kondisi dan kesinambungan manajemen pelayanan semua domain ccTLD .id pada saat ini sedang dibawah ancaman serius. Gerakan paling akhir oleh APJII untuk mendorong instalasi sebuah organisasi yang sama sekali baru untuk menangani pelayanan tersebut, walaupun masih didalam batas-batas hukum, telah dilakukan dalam cara yang tidak hati-hati, dan telah membawa ke arah situasi hari ini, yang secara serius mempertaruhkan nasih banyak kegiatan komersil (contoh: lionair.co.id) dan kegiatan resmi pemerintah (contoh: bi.go.id dan depkominfo.goid) Dalam menilai masala dengan skala yang demikian besar, kami memohon kepada Bapak Yth untuk mengambil waktu sejenak untuk membayangkan, apa yang akan terjadi jika akses ke semua domain ini menjadi tertutup, bahkan jika hanya untuk 24 jam. Walaupun cukup aman untuk mengasumsikan bahwa menginstalasikan sistem baru mungkin dapat beroperasi penuh antara 48 sampai 72 jam, kerusakan terhadap reputasi bisnis, dan kerusakan terhadap reputasi kita sebagai sebuah negara akan sangat parah dan dapat membutuhkan waktu bertahun-tahun untuk pulih. (contoh: sampai sekarang orang-orang masih mentertawakan bagaimana pelayanan Microsoft passport menjadi tidak bisa diakses selama 24 jam karena tidak ada yang ingat untuk memperpanjang domainnya) Maka dari itu kami ingin menunjuk bahwa yang berada pada akar masalah ini adalah suatu nilai yang merupakan dasar mutlak dari pengelolaan dan pemerintahan manapun yang berhasil, dan nilai tersebut adalah Kepercayaan. Komunitas mempercayai Bapak Yth, dan itulah sebabnya beberapa usulan telah dibuat agar Bapak Yth mengambil alih kendali kontrol pengelolaan selama waktu yang disebut "masa transisi". Namun Kepercayaan, Bapak Yth, adalah sesuatu yang diperoleh, bukan diberikan, dan adalah sangat jelas bahwa APJII sebagai pengusul perubahan, belum memperoleh Kepercayaan dari komunitas (kami menekankan fakta bahwa tidak seorangpun di luar APJII telah melihat bahkan bagian dari rancangan AD/ART organisasi baru ini, yang dikatakan "siap mengambil alih"). Dalam hal ini, kami tidak mengacu pada Internet Service Provider manapun, karena kami yakin bahwa mereka dipercayai oleh pelanggannya masing-masing. Namun, kami mengacu pada APJII sebagai suatu kesatuan, dan untuk tepatnya, orang-orang yang mewakili APJII dalam masalah ini. Sebagaimana Bapak Yth telah diinformasikan, manager yang sekarang dari ccTLD .id telah menolak untuk menyerahkan aplikasi pengelolaan kepada organisasi baru, namun ini bukanlah informasi yang tepat. Kebenarannya adalah, aplikasi yang digunakan oleh manager saat ini adalah hak kekayaan intelektual dari beberapa anggota komunitas, yang telah dipinjamkan kepada Bapak Budi Rahardjo secara pribadi. Maka dari itu aplikasi tersebut tidak boleh dipindahtangankan tanpa pernyataan tersurat dari para pemilik intelektual propertinya, dan secara gamblangnya, mereka berada pada posisi menolak membiarkan orang lain menggunakannya. Jika ijin tersebut didapatkan secara paksa, kami khawatir bahwa hal ini akan menciptakan masalah lebih besar dalam industri, memperbaharui cap "pembajak" atas kita, yang telah kita usahakan sekuat tenaga untuk hilangkan dalam beberapa tahun ini. Karena Internet Society dan chapter-chapternya terutama berkepentingan terhadap perkembangan dan kesinambungan internet di seluruh dunia, chapter kami telah berusaha menjembatani perbedaan antara APJII dan komunitas. Sayangnya, sampai hari ini, pertanyaan resmi kami telah berlalu tanpa dijawab, dan maka dari itu, kami tidak dapat meneruskan lebih jauh dalam arah ini. Namun, kami telah memastikan fakta bahwa penyebab utama keberatan dari komunitas adalah karena para registrants tidak diberikan kesempatan memberikan suara dalam hal ini. Sehubungan dengan ini, kami kembali memohon kepada Bapak Yth untuk mempertimbangkan fakta bawah satu-satunya penyebab adanya manajemen tersebut, adalah untuk melayani registrant, maka registrantlah yang seharusnya memberitahu manajemen bagaimana mereka ingin domain mereka dikelola, dan bukan sebaliknya, terutama bukan dari organisasi lain yang memiliki kepentingan titipan. Begitu kita sepakat dalam hal ini, kami yakin bahwa Bapak Yth dapat melihat bahwa solusi dalam masalah ini cukup sederhana, dan berikut ini adalah solusi yang diajukan oleh para registrant, sebagai stakeholder sejati dalam masalah ini: "Bahwa semua usulan perubahan terhadap manajemen ccTLD .id yang sedang beroperasi, harus terlebih dahulu dihadirkan secara lengkap kepada semua registrant dari domain .id, dan harus diberikan cukup waktu untuk pembahasan menyeluruh mengenai efek positif dan negatif dari perubahab tersebut. Lebih jauh, tidak ada perubahan yang boleh terjadi, kecuali secara resmi disetujui oleh anggota dalam sebuah pemungutasn suara yang mewakili tidak kurang dari 50 % + 1 dari semua registrant." Kami telah diberikan indikasi-indikasi positif, bahwa jika solusi yang diajukan ini dikabulkan, maka pelayanan dapat berlanjut seperti biasa, dan jika ada organisasi yang disetujui oleh para registrant untuk mengambil alih pengelolaan domain mereka, serah terima akan berlangsung dengan mulus, dan para pemilik dari intelektual properti diatas akan dengan senang hati memberikan pinjaman program aplikasinya kepada para manager baru. Pada akhir pernyataan ini, kami ingin mengutarakan harapan tinggi kami terhadap kebijaksanaan Bapak Yth, dan kami percaya bahwa Bapak Yth akan setuju bahwa proposal kami ini sesuai dengan program Transparansi dan Demokrasi, sebagaimana dideklarasikan oleh Yth Presiden Republik Indonesia.
