The restaurants are charging the customers a surcharge to supposedly cover the employee health accounts, the employees are not using the full amount of the health accounts, and what they don't use is returned to the employers. Because of this, some employers are making a profit off the surcharge.

I regard this situation as a corruption of incentives. Perhaps the law of unintended consequences is at work here. If what you say is true and that's just how PHAs work, then it gives the employer a specific financial incentive to have the employee pay into a benefits system that they will not use
