Federal District Court Judge Reed O'Conner has ruled that 10 ICE agents and
officers have standing to challenge in Federal court the so-called Morton

No one is questioning his right to make recess appointments. The legal
issue in this case is that he doesn't get to decide when Congress is in
recess.
The ruling was broader than it needed to be to settle that issue, so likely
this will go promptly to SCOTUS.
