WASHINGTON -- The Pentagon agreed Tuesday to patrol the skies over the nation's capital with secret surveillance planes, now used to combat drug lords in Colombia and to track military movements in North Korea, as part of a broadening effort to nab the Washington-area sniper.

The move reflects a growing frustration among law enforcement personnel over the sniper's ability to elude detection, despite a multipronged investigation and the wide dragnet that was cast in suburban Washington after the latest shooting.

The case became more personal for the FBI on Monday when the bureau lost one of its own. Linda Franklin, a 47-year-old intelligence analyst, was gunned down in the parking garage of a Home Depot in Falls Church, Va.

The number of law enforcement personnel working on the manhunt grew to more than 1,000 on Tuesday, with at least 14 federal, state and local agencies in Maryland, Virginia and the District of Columbia involved in the investigation, officials said. Even the CIA has begun lending assistance, using its bomb-sniffing dogs for traffic stops.

The investigation "is extraordinary in terms of the diversity of federal involvement," a Justice Department official said on condition of anonymity. "The urgency we're seeing grows out of the fact that every day that passes without catching this guy, another innocent person may be murdered."

The deployment of the Army's Airborne Reconnaissance Low planes is the latest and perhaps most drastic tactic in the sniper investigation. Responding to a request from the FBI, Defense Secretary Donald Rumsfeld agreed Tuesday to deploy a handful of the spy aircraft. The planes are equipped with a range of special sensors and detection capabilities and appear similar to commuter airplanes to avoid easy detection.

Although details of the deployment were shrouded in secrecy, federal authorities plan to use the planes for around-the-clock surveillance to pinpoint and respond to sniper attacks, officials said.

Military and Justice Department officials wrestled for much of the day with the question of how and whether the Pentagon could aid in the sniper investigation without violating an 1878 law, the Posse Comitatus Act, which restricts military personnel from taking part in domestic law enforcement operations. Lawyers decided the military could offer equipment in the manhunt without violating the law.

"Every step in this process is taken so that we remain within the limits of all laws, including Posse Comitatus," Lt. Cmdr. Jeff Davis of the Pentagon said.

Federal troops have been used occasionally through U.S. history in domestic law enforcement roles, including putting down the Whiskey Rebellion in 1794, integrating schools in Little Rock in 1957 and restoring order in Los Angeles during riots after the Rodney King verdict in 1992.

The military operates a handful of the all-weather, specialized planes, with some based at Fort Bliss in Texas, to support counterdrug operations in Latin America and a few others in South Korea to monitor eavesdropping in the North.

As part of their expanded role in the investigation, the FBI and the Bureau of Alcohol, Tobacco and Firearms have committed a total of nearly 800 employees to the investigation, aiding with ballistics testing, forensic analysis, psychological profiling and other areas in which they have special expertise.

Senior military officers worried Tuesday that the use of military tools in a criminal investigation could spark further requests for help in other notorious crimes while U.S. troops are in Afghanistan and gearing up for possible war with Iraq.

"The concern among the military is, we're not a domestic law enforcement agency," a senior Pentagon officer said. "We have a lot of equipment that I would want, too, if I were a police chief, but it's the same equipment we need to fight a global war on terrorism, as well as Iraq."

WASHINGTON -- The U.S. Army plans to spend $2 billion on a new fleet of aerial surveillance and reconnaissance planes to be fielded in 2006. The planes, known as Aerial Common Sensor, will replace three existing planes, the Guardrail,
Aerial Reconnaissance Low and Crazy Horse (ed. - Crazy Horse was retired from the USAR on 30 Sep 1998). The service has committed $2 billion (ed. - airframe costs alone could reach $1.8B leaving insufficient funds to procure the mission equipment) in its 2000-2006 budget plan, known as the Program Objective Memorandum, and Army officials currently are writing a requirements document to be released later this year.

Airborne Reconnaissance Low uses DeHavilland-7 aircraft, some (ed. - seven out of eight) of which have a signals intelligence system capable of locating radio emissions and providing reports to commanders and intelligence officers via high frequency, very high frequency, ultra high frequency and satellite relay. Others provide imagery data.
 
The RC-12G Crazy Horse was built by the U.S. National Security Agency, the government's top spy agency, for specific missions in Central America. Guardrail and the Aerial Reconnaissance Low have flown in Operation Desert
Storm, Haiti, South Korea, Panama and Bosnia and are used daily throughout the world, Army documents say.
 
The Army owns three Crazy Horse planes, all of which are being retired (ed. they have been since 30 Sep 1998);  50 Guardrail planes (Ed. - 48 really, but only 36 are operational, including six used for training, the other 12 have yet to be fielded); and nine (ed. eight, the program ran out of money to equip the ninth aircraft) Aerial Reconnaissance Low planes, two of which remain to be fielded. The two Aerial Reconnaissance Low planes yet to be fielded will combine imagery and signal intelligence capabilities, and will be as capable as the U.S. Air Force's RC135 Rivet Joint aircraft used in
the 1991 Persian Gulf war, Gust said.
 
"It's got processors on it, it's got fiber optics, it's got the capability to listen and find everything out there," he said.

HISTORY

     Activated on October 14, 1983, at Lakehurst, N.J., the unit was recognized on April 2, 198X, as the Military Intelligence Battalion (Low Intensity) (Provisional), subordinate to the 513th Military Intelligence Brigade.  On July 15, 198X, the battalion relocated to Pomerola Air Base, Honduras.  While serving in Honduras, the unit formally activated as the Military Intelligence Battalion (Low Intensity) on October 1, 1989.

    The MI battalion (LI) was assigned to INSCOM as a subordinate unit of the 513th MI Brigade and attached to the 470th MI Brigade while forward deployed to Central America.  Prior to July 1991, the MI battalion (LI) consisted of a split-based TDA organization with the battalion commander, Staff, Headquarters Service Detachment, Alpha Company and Bravo Company forward deployed to Soto Cano Airbase, Honduras.  The remainder of the battalion, Headquarters Service Company and Charlie Company, was based in Orlando, Fla.

     Delta Company (Provisional) was established in 1991. Funding, planning and development of unit structure proceeded through the end of FY91. Delta Company (Airborne Reconnaissance Low) was formally activated January 1, 1993, at Howard Air Force Base, Panama, and further designated as Delta Company (Forward).  The company returned to Fort Bliss, Texas, in Summer 1999 as American forces left Panama under the provisions of the 1977 Panama Canal Treaty.

     In the summer of 1993, Bravo Company (Crazyhorse) and Charlie Company (Guardrail) began relocation from Honduras to Orlando.  The relocation was completed in August 1993. In March 1994, Alpha Company reconstituted from a Seaborne Operations to an Operations Company and relocated to Orlando.

     Bravo Company (Crazyhorse) completed relocation of its assets to Orlando in May 1994.

     In September 1994, Bravo Company (Crazyhorse) transferred all of its assets to the 138th MI Company (Reserve) and deactivated.  In October 1994, Charlie Company (Guardrail) retired its assets and activated as Charlie Company (UAV) (Provisional) for future inclusion of unmanned aerial vehicles.

     The unit began its relocation to Fort Bliss, Texas, completing the move in August 1997.  Today, the 204th Military Intelligence Battalion (Aerial Reconnaissance) consists of Headquarters Service Company, Charlie Company, Delta Company.  The 204th "VIGILANT HUNTERS" continue to support operations in several theaters around the world with ARL.

Wernher Von Braun (1912-1977)

With 120 of his associates, von Braun was brought to the U.S. as part of "Operation Paperclip" in order to demonstrate their achievements with V-2 rockets. He arrived in the U.S. in September 1945 under contract to the U.S. Army. During the following five years, he directed high-altitude firings of V-2 rockets at the White Sands Missile Range in New Mexico and was project director of the guided missile development unit at Fort Bliss, Texas.

In 1950, the Fort Bliss rocket development group was transferred to Huntsville, Alabama, where the Army centered its rocket development activities. In Huntsville, the von Braun team worked on the ballistic rockets called Redstone, Jupiter C, Juno, and the Saturn 1B.

Von Braun and his team were transferred from the Army's control to NASA's when the National Aeronautics and Space Administration was established in 1958. Von Braun became director of NASA's Marshall Space Flight Center (MSFC) in Huntsville, which was dedicated on July 1, 1960. The von Braun team members were given a choice whether to go to NASA or stay with the Army Ballistic Missile Agency. All elected to be transferred to MSFC on this same date.

When President Kennedy called for a Moon landing within the decade, von Braun was asked to lead the effort to design and build the rocket. The Saturn V, developed by MSFC, won the race with the Soviet Union to put the first men on the Moon in 1969. After the Moon landings, at the insistence of the NASA Administrator, von Braun, in 1970, went to NASA Headquarters in Washington, D.C. to serve as Deputy Associate Administrator and to promote space activities. But public interest and support had declined, and von Braun resigned in May 1972 to become vice president for engineering and development at Fairchild Industries, Inc.

In 1975, he founded and became the first president of the National Space Institute, a private group designed to increase public understanding and support of space activities.

Von Braun died on June 16, 1977, and was buried in Washington, D.C.

On 8 November 1955, Secretary of Defense Charles Wilson issued a significant decision concerning this nation's long-range ballistic missile program. Wilson's orders covered the long-range ballistic missile program, which included two ICBMs and two IRBMs. All were to be afforded the highest national priority, with a qualifying stipulation that the IRBMs were not to interfere with ICBM development. The Army, in cooperation with the Navy, was to develop IRBM #2 (later named the JUPITER) to achieve an early land- and sea-based capability. To direct the program from the top level, a joint Army-Navy Ballistic Missile Committee (or JAN-BMC) was established, with the Secretary of the Navy serving as Chairman and the Secretary of the Army as Vice Chairman. They, in turn, reported to the Ballistic Missile Committee, which the Secretary of Defense established in his office. Secretary of the Army Wilbur Brucker and Army Chief of Staff Maxwell D. Taylor relayed the word to all army elements that the IRBM #2 program was to carry top priority in the Army.

 Major General John B. Medaris was made Commanding General designee of the to-be-formed Army Ballistic Missile Agency on 22 November 1955. Exactly one month later, the general orders were published activating ABMA, with an effective date of 1 February 1956, as a Class II activity under the Chief of Ordnance. A major factor influencing the recommendation of assigning this project to this Army agency was the availability of facilities at Redstone Arsenal. ...More importantly, the decision to allow the Army at Redstone Arsenal develop the JUPITER was based on the fact that Redstone Arsenal had experience developing and fielding missile systems and had recently turned over production of the REDSTONE system to a contractor. ...When ABMA was established in 1956, Secretary Brucker delegated to the Commanding General of ABMA (through the Chief of Ordnance) specific powers and authorities covering nearly every legal authority in the development and procurement field which could legally be delegated. The ABMA Commanding General could deviate from established Army procurement procedures and regulations, use other Ordnance installations and activities on a priority basis, and issue instructions directly to other Army agencies to accomplish his assigned mission. ...

By early 1958, the growing need for centralized control of the development of a variety of missile weapon systems of all types made it apparent that the management and development workload had grown to the point that an ordnance materiel command was necessary. For this reason, the Army Ordnance Missile Command (AOMC) was established on 31 March 1958. General Medaris became the Commanding General of that organization. ABMA was also designated as a subordinate agency of AOMC and no longer required the specially delegated powers. These were transferred to the Commanding General of AOMC for application to all Special Priority Programs assigned to the Command. The NIKE ZEUS Program had the highest Army and national priority by that time in 1958....One of the key items of the delegation of powers was the phrase "subject to the availability of funds." ...

In the normal course of operations, the various regulations dealing with Army or Armed Services procurement were used by the ABMA Commanding General as limitations and as a basis for his own policy limitation on exercise of the Special Delegations. Even when deviations were necessary, the activity requiring the special assistance had to provide documentation justifying that the use of the special powers was the only recourse available. Each such request was required to be carefully scrutinized by the ABMA's General Counsel and receive his concurrence before being presented to the Commanding General for his critical review.

The Agency primarily operated within the limitations of the appropriate procurement regulations. In view of the urgent need to develop the JUPITER, it would appear that the Commanding General might have authorized his contracting officers to use letter contracts extensively as an expedient as opposed to negotiating definitive contracts. Such was not the case. Army procurement procedures discouraged the use of such means first, and was the basis of the restrictive policy on the ABMA Commanding General on the use of letter contracts. If letter contracts were used, the policy was very specific: he required justification for such action and the means by which it would be accomplished. Such contracts were to permit expenditure of funds only to 50 per cent of the total estimated amount of the definitive contract. Under normal Army procurement procedures, if an amount beyond the cited 50 per cent were necessary, review would have had to be made by and approval received from the Contracts Branch in the Office of the Deputy Chief of Staff for Logistics. Such cases under ABMA programs required the approval of the Commanding General who used his delegation to authorize a deviation from regulation.
