Roger Clinton's Drunk-driving Alibi Unraveling


As recently as last month, former first brother Roger Clinton's attorney
Mark Geragos was boasting on national TV that audiotapes of radio
dispatches would prove Hermosa Beach, Calif., police set his client up on
drunk-driving charges on Feb. 17.

But on Monday Geragos told a California judge that the cops stopped talking
on the radio that night so no one would hear them plotting against Clinton
on police scanners. Instead, he said, police tried to conceal their plot to
set up the former first brother by using their personal cell phones.

Geragos had already requested and received records for Hermosa cops'
official cell phones, according to a report in Tuesday's Daily Breeze, the
local California paper covering the case in detail.

But apparently those records weren't enough to show evidence of the
anti-Clinton plot Geragos imagines - so he asked Superior Court Judge Jesse
Rodriguez to order Hermosa Beach PD to turn over records for officers'
personal cell phones.

According to the Daily Breeze, "It's not clear if any officers used their
personal cellular phones that night. Three officers used city-issued
phones."

Needless to say, whatever evidence Clinton's attorney finds in the reams of
cell phone records he now wants, it won't include audiotapes of the cops'
conversations - recordings he suggested, just two weeks ago, would prove
their plot to nail Roger.

On June 21, when the Los Angeles lawyer and his client appeared on CNN's
"Larry King Live," King asked Geragos, "Do you think he's going to lick
this [DUI charge]?

"Do I think he's going to lick this?" Geragos shot back. "Once I got hold
of that tape ... where they - and you heard the tape, I just am
hard-pressed to see how anybody is going to say ... "

Say what? Geragos didn't finish the thought.

But in May the lawyer was more specific, telling the Daily Breeze that his
tapes showed that Hermosa Beach police had engaged in "vindictive or
retaliatory prosecution" of Roger Clinton.

So where are these allegedly damning tapes? Why haven't we heard the
smoking gun proof of a conspiracy to persecute the former first brother?
Turns out, Geragos is refusing to release his recordings.

But he told reporters covering Clinton's May drunk-driving hearing that the
tapes included the following conversation:

"There he goes, do you recognize him?

"Does he have Secret Service protection?"

"No, but his brother sure does."

How this snippet even suggests, let alone proves, a police plot to set up
Roger Clinton on phony drunk-driving charges is anybody's guess -
especially after he failed two breathalizer tests immediately after his
2:30 a.m. arrest.

And the tapes, or at least the portion of them Geragos has revealed, would
seem to have no bearing whatsoever on the altercation Clinton got into with
a local bar bouncer 40 minutes before cops pulled his weaving Ford
Expedition over.

Staff at Hermosa Beach's Lighthouse Bar had refused to serve Clinton, who
responded by allegedly challenging the bouncer to a fight and boasting,
"I'll kick your ass."

The hunt by Roger's lawyer for ever more cell phone records makes it
apparent his tapes won't prove what he said they would. Still, Geragos had
his client plead not guilty Monday.

Roger Clinton's drunk-driving trial is set to begin on August 7 - if he
isn't indicted on Pardongate charges first.
