Clinton Lawyers To Skip Hearing

WASHINGTON wo top lawyers for the Clinton administration have
balked at appearing at a congressional hearing today looking into
the pardon of Marc Rich, leaving former Deputy Attorney General
Eric Holder to take the heat.

Holder, who was the acting attorney general in the final days of
Bill Clinton's presidency, will be the sole administration
witness at the hearing by the House Government Reform Committee.

Also testifying will be Rich's lawyer, Jack Quinn, and the two
Manhattan federal prosecutors who originally brought charges
against the financier.

The hearing, led by Rep.  Dan Burton (R-Ind.), was expected to
produce fireworks from the high-profile witnesses, who are angry
at Clinton or each other.

"It could get interesting, if you know what I mean," a committee
source said.

Two potential witnesses — former White House counsel Beth Nolan
and assistant counsel Bruce Lindsey — turned down invitations to
testify.

Nolan sent word that she was in the Bahamas, and Lindsey sent a
letter saying he would be out of town, and "for that reason and
others, I will not be able to accept your invitation."

A committee spokesman said Nolan and Lindsey would be subpoenaed.

Clinton loyalists have spread word that their ex-boss is seething
at Quinn, a former White House counsel who was hired by Rich to
lobby the then-President for a fee that Quinn said was "in the
low six figures."

Quinn has been doing some seething himself at the firestorm of
criticism aimed at him for allegedly bypassing the Justice
Department by taking Rich's pardon petition directly to Clinton.

He released a series of memos last week indicating that he told
Holder several times about his maneuvering.  Law enforcement
sources said Holder is now angry at being set up as the fall guy.

Two other witnesses, former Assistant U.S.  Attorneys Morris
Weinberg and Martin Auerbach, have made plain that they are mad
at everybody involved in getting the pardon for Rich.

Weinberg and Auerbach have used the term "outrageous" to describe
the pardon for the billionaire, who fled to Switzerland in 1984
rather than face indictment for trading oil with Iran during the
hostage crisis and evading $48 million in taxes.

In his filing with the White House supporting the Rich pardon,
Quinn included letters of support from top Israelis citing Rich's
use of his international contacts to aid Israeli intelligence.

Burton, whose previous hearings on White House scandals often
ended in pointless partisan bickering, is expected to seek
testimony at future hearings from Rich's ex-wife, Denise Rich, a
Manhattan songwriter and Clinton friend who has given more than
$1.3 million to the Democrats.
