That leaves only the province of British Columbia to rule on the package. Ontario Justice Warren Winkler voiced concerns at a hearing last month whether the proposed package would be enough to compensate about 10,000 tainted-blood victims, who contracted hepatitis C through transfusions between 1986 and 1990. But he ruled yesterday that the settlement, which amounts to $1.56 billion with interest, should be sufficient. It will pay victims according to how sick they are, with individual payments ranging from $10,000 to $1 million. "I always believed that this fund was sufficient, that's why we made the deal," Harvey Strosberg, lawyer for some of the class action plaintiffs, said late yesterday. Mr. Strosberg said that in the ruling the Ontario judge "specifically said that he's not concerned about that. That the risk of insufficiency is minimal." "He's called this plan progressive, forward-looking and imaginative -- those are important adjectives." The Ontario judge wanted three minor issues addressed including if and when a surplus of the fund will be dealt with. "He says they are not material issues," said Mr. Strosberg, adding there will be more hearings to discuss those factors. Mr. Strosberg said he believes money will be available to victims as early as January, depending on B.C. approval, which he expects "imminently." The settlement, however, will not be available to about 20,000 Canadians who contracted hep C from tainted blood before 1986 and after 1990. Now, Mr. Strosberg said, a yet-to-be appointed counsel and an administrator will embark on an advertising and information outreach program to notify potential class-action members of their rights. It will also inform victims that they can opt out if they want to pursue private claims. The settlement amount was also based on assumptions that a certain percentage of victims would opt out of the package and that only 70 per cent would come forward. "It ain't over until it's over, but we've gone a long way down the road today," said Mr. Strosberg, adding that lawyers' fees will be "the last thing the court deals with -- I think the judge found that the fund will be sufficient after he projected legal fees." **COPYRIGHT NOTICE** In accordance with Title 17 U.
