-Caveat Lector- From: Frontline: http://fps1999.webjump.com/ WACO INFORMATION CONTINUES TO SURFACE By. John Culbertson There are more developments in the Waco case. Reports are circulating that Federal Marshals have served search warrants on the Federal Bureau of investigation Headquarters in Washington and have seized additional unseen until now evidence regarding the FBI's conduct at Waco. In another development the Justice Department is challenging a federal judge's authority to take control of evidence under the control of the Texas Department of Public Safety (DPS), despite the fact that DPS has filed a motion requesting that he do so. MILITARY DOCUMENTS DESTROYED FRONTLINE has obtained documents that show yet another component of the puzzle that we see unfolding about us. Documents that have been obtained by FRONTLINE show that the US Military destroyed "all files" concerning the support mission at Waco on or about October 1, 1994 about a year and a half after the fire that destroyed the Davidian compound and almost a year before Congressional hearings into the series of events now characterized as Waco. In other words important files were discovered during the course of a Congressional investigation. The document, a United States Army Special Forces Command "Staff Action Summary Sheet" on the subject of the "DISPOSITION OF FILES REGARDING USASFC COUNTERDRUG SUPPORT IN WACO. TEXAS" is dated November 21, 1994 is a routine enough report. But the routine nature changes when one discovers in item 2 "DISCUSSION" that "All files concerning this mission support have been destroyed on or about 1 October, 1994." FRONTLINE contacted military affairs expert Lt. Col. Roger Charles (USMC Ret.) who inspected the document and talked to FRONTLINE regarding the normal disposition of documents within the US military system. When asked about the normal procedures for the handling of files particularly ones regarding actual missions, Charles replied: "It is very unusual (to destroy documents) particularly in a high profile case, even routine documents are supposed to be retained for 2 years." Charles went on to characterize the destruction of the documents as a "Flagrant violation of regulations and says very loudly that someone was very concerned about something that would happen later." It is clear that an order originated somewhere to cause the destruction of the files. By doing so during the course of an official investigation by Congressional committees into the actions taken at Waco, the destruction of these files in all likelihood constitutes obstruction of justice. SPECIAL FORCES INVOLVEMENT Other information that can be gleaned from this document include the fact that the mission originated in February of 1993, and was carried out by Joint Task Force Six and the 3rd Special Forces Group. According to the US Army Joint Task force Six can be described as follows: "Joint Task Force Six (JTF-6), located at Biggs Army Airfield, Fort Bliss, Texas, is assigned to U.S. Atlantic Command, under the operational control of the U.S. Forces Command. JTF-6 is a multi-service command comprised of approximately 159 soldiers, sailors, Marines, airmen, and civilian employees. JTF-6's role in the counterdrug effort is articulated in its mission statement: "JTF-6 synchronizes and integrates DOD operational, technological, training and intelligence support to domestic law enforcement agencies' counterdrug efforts in the continental United States to reduce the availability of illegal drugs in the United States." 3rd Special Forces Group is headquartered at Ft. Bragg, North Carolina and like most Special Operations groups the Army has little comment regarding these operational units. Other documents support the involvement of forces from Ft. Bragg in the pre raid planning activities and training. This raises questions as to just what the involvement was of military units in the entire operation from pre-raid planning all the way through the final assault and deadly fire. The destruction of evidence in contravention of established procedures and records is troubling to say the least. The very fact that Special Forces command had a concern as to the disposition of files regarding the operation raises troubling questions regarding the actual involvement of the US Military at Waco. Because the US Military acts only at the request and pleasure of civilian control, questions regarding the entire operation must focus on the Department of Justice, Treasury and with the Administration. There are currently discussions in Washington on forming a joint House-Senate Committee to investigate the activities of all parties involved in the events at the Davidian compound in Waco. Formation of an independent investigative body to fully explore the evidence and report to the American people on the conduct of their government is a needed first step in restoring the credibility of Federal Law Enforcement. There is no doubt that recent developments have severely damaged the reputation of Federal Law Enforcement agencies and only clear, concise and accurate accounting will restore the faith the system requires in order for Federal agencies to be truly effective. Current reform efforts such as the Federal Protective Service Reform Act of 1999 (HR 809) provide a good model of legislative control, effective identification of the mission and reasonable authority with which to carry the mission out.
