Prosecutors had asked Judge Frank Nelson last week to vacate the order to release the tests because they feared an endless court battle. "We don't have the resources and the time to devote to it," Buena Vista County Attorney Phil Havens told the judge at the time. Authorities had sought nine months of records from the Storm Lake clinic in their stalled investigation into the death of the baby, whose body was found at a recycling center in May. Nelson had ordered Planned Parenthood to release the names and addresses of all women with positive pregnancy tests between Aug. 15, 2001, and May 30, 2002. The group appealed to the Iowa Supreme Court, arguing that the order was an invasion of privacy.
