Adam's patch is pretty trivial. I developed the new feature for the kernel and agree that his patch solves the issue. I also don't see any problems with this patch for kernels that have CONFIG_VGACON_SOFT_SCROLLBACK=n. We tested this escape sequence for kernels with and without CONFIG_VGACON_SOFT_SCROLLBACK and CONFIG_VGACON_SOFT_SCROLLBACK_PERSISTENT - there were no issues.
