use the compatability routine which uses open directly to /dev/ptyXY,
and

When kernel is compiled without CONFIG_LEGACY_PTYS, vtun does not work with
the following syslog message:
vtund[6710]: Can't allocate pseudo tty. No such file or directory(2)
