No I would not mark it as fixed. I just ran into some H.264/AVC-encoded quicktime trailers where I get that exact same faad-related "Maximum number of scalefactor bands exceeded"-error. The example clips below used to work just a few days ago. I don't know in which update-cycle they stopped work
