No I dont need a backport because I circumvent the problem by using my custom
3.9 kernel.
Will upgrade to Saucy as I now know its resolved with that.

Just tested out using the latest Saucy image and I am not able to reproduce
this problem.

I have built a kernel from the upstream mainlinekernel following this
doc: https://wiki.ubuntu.com/KernelTeam/GitKernelBuild
The kernel was version 3.9-rc4.
Booting in to this v3.9 kernel has solved my problem.
