DALLAS – Downtown tourism has few characters more spirited than Ricardo
Hernandez, 39.

But he's a little sore at the city.

"I feel like the city is looking for another reason to stop me from doing
business," Hernandez said. "I don't feel like they are picking on me, I feel
like they are looking for new rules and regulations to slow me down."

Hernandez owns Dallas City Tour, but just found out that his two newest
vehicles – open-air electric carts adorned with longhorns – are not
permitted by the city to operate on the road.

"As far as I know, there wasn't an ordinance for them," he told News 8. "A
year ago, there wasn't an ordinance, so why check again?"

They have seat belts and Hernandez said he carries insurance. Temporary
paper tags are taped behind the ad on the rear of the vehicle.

Hernandez said he first started giving tours in them three weeks ago – $15
for a 45-minute drive around the Central Business District.

But he isn't supposed to carry paying passengers without Dallas'
"transportation-for-hire" permit.

The city passed this new ordinance late last year, but it didn't go into
effect until April. Despite a $500 fine, Hernandez said he will not park his
ride and wait for the city to process his paperwork.

"They're stopping out here on Elm Street, in one of the busiest streets in
downtown Dallas," said Farris Rookstool III, a JFK historian.

He is suspect of the new open-air electric carts and worries they're unsafe
for unknowing tourists in an already-congested area.

"If it's slow moving," Rookstool continued, "they're supposed to have a
slow-moving vehicle sign attached to the back of the vehicle."

Hernandez dismisses the concern, and said the carts he calls "Cruzers" are
street-legal, despite currently operating illegally while ferrying
passengers to popular attractions.
