Team 10 found that there's a solution that the HOA refuses to use. Mary Limoges said buying her mother a brand new car was something she always wanted to do. "I said, 'This is your new car,' and she burst into tears. She was so excited," said Limoges. The garage that is supposed to house the brand new Nissan Leaf is filled with boxes and junk instead. "The car is sitting out front of our house not being used. All because, in my opinion, they can't face this issue to be in the 21st century," said Limoges. Limoges owns the condominium in Oaks North where her mother lives. She said she had to get the HOA board's permission before she plugged the car into the electrical outlet in the garage. She also said she called San Diego Gas & Electric for guidance. "Let's take the formula from SDG&E, which would come pretty close to approximate what the cost would be, and we'd gladly pay that every month," said Limoges. An SDG&E spokeswoman told Team 10 it's a different amount for every HOA, but there is cost formula customers can use. An electric vehicle will get three miles per vehicle per kilowatt hour. The HOA would know what rate they are on to figure out the kilowatt hour to use in the formula. Limoges pays $28 a month to plug in her electric car at home. "I was met with an extreme amount of resistance," said Limoges. She said the board said no to the formula idea. "They said we needed to submit architectural plans, install a whole separate meter, go through permitting process and go before an architectural review board here at the complex," said Limoges. Team 10 called the board president, Ted Batton, and asked how the board came to their decision. "I work for a living. I don't answer HOA questions during my work day," said Batton over the phone. Team 10 asked when he did answer HOA questions and Batton said at the meetings before he hung up. Team 10 went to the meeting and was kicked out before it started. Batton said he was too busy to step outside. Team 10 learned Batton is no longer the Oaks North board president -- it's still unclear if that means Limoges will get to pay more and plug in. "I want my mom to have her car and pay what's fair for the extra electricity and move on," said Limoges. Team 10 also reached out to the HOA's property management company. A woman from Elite management sent a civil code in response to Team 10's questions. Under the Davis-Stirling Act, HOAs cannot stop an owner from requesting to install an electric vehicle charging station, but they don't have to pay for it. Limoges is not asking to install a charging station but is offering to pay more per month to charge her car in her existing, free-standing garage. SDG&E said they will work with customers to come up with the best solution.
