As you can see the key to our problem is "This software is available to you under a choice of one of two licenses” and for linux the coice is clear. There is nothing that says both licenses have to be preserved. https://git.kernel.org/cgit/linux/kernel/git/torvalds/linux.git/tree/drivers/infiniband/core/addr.c?id=30dc5e63d6a5ad24894b5512d10b228d73645a44 /* * Copyright (c) 2005 Voltaire Inc. I have not set up a meeting because I am still trying to ensure that I thoroughly understand the sequence of code contribution and integration that occurs step by step with OpenFabrics Software (OFS) as it is contributed, goes thru the steps it goes thru, etc. Also could we talk today, as soon as you wish, for you to identify to me verbally what NetApp’s issue really is, or is there a misunderstanding at the legal level within NetApp. Please call 510 375 -8840 as soon as convenient, but I’m in Austin TX. My schedule is generally flexible. This week, Thursday afternoon PST, and Friday after 10:30am PST look good. Next week, Monday and Tuesday are the best days (and Thursday is impossible). If a different time than those works better for you, feel free to suggest it. John ________________ John T. Dave is the focal point for the concerns which I understand are being voiced by NetApp legal staff. When I identified you as OFA counsel, he asked for this email introduction. I’m going to go back over my notes to remind myself of earlier investigations, which I thought had been definitive. In any case, there are clearly some gaps, possibly only in communications, which we may need to address Thanks and regards, Jim
