If en banc review is granted it should appear at http://www.ca9.uscourts.gov/enbanc/view.php?pk_id=37 and it has not as of this writing. It is overdue for a decision, so at this point is seems likely there will be no en banc review. -- Jon --

Does anyone know the timeline to hear if the 9th took a vote and the results? If no one calls for a vote or if the vote fails will there definitely be a memorandum on their website? Is it possible that they don't vote to take the case en banc and don't make ANY announcement since the en banc pro

Agreed. So why didn't the Roe Court bother to at least mention the 9th Amendment? I don't recall any such reference in the opinion. Please correct me if I am wrong. Why didn't Grisworld v. Conn. use the 9th Amend. theory or a natural rights theory rather than the ludicrous penumbras theory?

Doesn't need to. The Ninth Amendment covers that. I discuss the issues in that case here. But even if there weren't a Ninth Amendment, fundamental rights precede and are superior to the Constitution. They don't stem from it and don't need to be mentioned in it. See Social Contract and Constitu
