Coupled with traffic to the other IPs in the swarm (which cannot be
securely encrypted, I think?) would probably convince many juries.

That could help. Tracker is still going to provide a list of IPs
participating in each torrent if you ask though, yes?

Consider an encrypted torrent - it should be fairly easy to identify
that it's a torrent by traffic analysis, but no clue what it is
