Bail granted to the 4 arrested in “Lucknow Incident”
 
 
In recent move the session court of Lucknow has granted bail to the 4 Men
arrested earlier for allegedly running Gay Club in Lucknow.
 
Rajesh Sharma, advocate, state that the points of argument were:
 
Section 377:
Medical evidence was absent
There was no complainant in the case
Delay in lodging the FIR – The four men were arrested on 3rd January 2006,
at 08:30 PM, whereas the FIR was lodged at 00:40 am on 4th January 2006.
 
Running of a gay club in Lucknow – There was no evidence of gay club in
Lucknow. A website cannot be called a gay club.
 
The police was the only complainant. No other evidence was submitted.
 
The location (Kookrail Village Forest) where the four men were allegedly
arrested is actually banned for general entry after 06:00 PM, whereas the
arrests supposedly happened at 08:30 PM, as per the FIR.
 
Bail was granted at Rs. 20,000/- security bond. There were no other
conditions.
 
The released order has been prepared and the detainees should be out of
custody latest by tomorrow.
 
Advocacy
 
Throughout this period of time, Bharosa and NFI have been in contact with
local, national and international agencies. UNAIDS offices in India, as well
as in Geneva and Bangkok, were involved in speaking with the local police
and administration towards ensuring that undue harassment of ‘MSM’ does not
occur to impede HIV/AIDS interventions for ‘MSM’. A significant outcome has
been the willingness of the police to support a workshop on HIV/AIDS and
‘MSM’ in collaboration with UNAIDS, Bharosa and NFI.
 
In Lucknow a range of human rights groups, NGOs, and womenÂ’s organisations,
with several people in their individual capacity have been actively involved
in the process of fighting for justice for four men arrested in Lucknow
incident.
 
The fact-finding team during their process of investigation had contacted a
range of bureaucrats, police officials and other related individuals, and
prepared a report which was distributed widely.
 
Protests and campaigns against the Lucknow arrests were also held all over
the country, including Delhi, Bangalore, Kolkata, Mumbai and other cities by
human rights activists and local NGOs.
