S NARAYAN:GOING OVERBOARD ON TAX CONCESSIONS (SEZ)

The SEZ Act of 2005, notified in February 2006, looked very much like a
one-upmanship game between the finance and the commerce ministries, with
the latter claiming victory after a series of meetings at the PMO. The
issues related to tax concessions and, in particular, treatment of
taxation within the SEZ zones. The new SEZ Act provides for stability in
taxation regime in that even the Finance Bills cannot take away the
concessions provided. The commerce ministry's arguments that a
predictable, transparent regime is necessary to encourage investments,
scored over the fears of the finance ministry about erosion of autonomy
