A complaint has been filed of disproportionate assets against Crime Branch
Police Inspector Dattaguru Sawant. In the omplaint submitted to the
Director General of Police it has been sought that an F.I.R be registered
against Inspector Dattaguru Sawant his wife Manuja Sawant, Antonio Caitan
Fernandes and  his wife  Freda Maria Castro Fernandes besides Gaurang Sinai
Suctancar partner of  Risara Properties for the offences punishable under
Sections 13(1)(d)&(e) 13(2) & 10 of the Prevention of Corruption Act, 1988,
Section 3 of the Benami Transaction (Prohibition) Act, 1988 and Section 4
of Prevention of Money Laundering Act, 2002 read with section 120 B and/or
34 IPC. A copy of the complaint has also been submitted to the Chief
Secretary and the Director of Vigilance while seeking their prompt
intervention in the matter.


In the complaint it has been stated that Dattaguru Sawant and wife Manuja
in collusion and connivance with Antonio Caitan Fernandes and Freda Maria
Castro Fernandes, both residents of Karapur Tisk in Sanquelim and with the
tacit support of Gaurang Sinai Suctancar entered into a benami transaction
and purchased Flat A-102, at Risara Luxuria in Taleigao admeasuring 138 sq.
mtrs. for which the entire consideration of Rs. 89,80,800 has been paid by
Dattaguru Sawant even though the Agreement is shown as the name of Antonio
Caitan Fernandes and Freda Maria Castro Fernandes, as purchasers in the
Agreement of Sale dated 31.7.2014 duly registered in the Office of the Sub
Registrar, Ilhas, under Serial No. 1790/14 dated 31.7.2014.


That it is a benami transaction is evident on the face of the Agreement for
Sale as the mode of the payment of Rs. 89,80,800  for that registered
Agreement is not spelt out as a result of which Dattaguru Sawant and his
wife Manuja, Antonio Caitan Fernandes, read Maria Castro Fernandes, and
airing Sinai Suctancar had  committed offences punishable under section 3
of the Prohibition of Benami Transaction (Prohibition) Act, 1988 and that
in the course of carrying out the transaction they have also committed an
offence of money laundering offence punishable under Section 4 of the
Prevention of Money Laundering Act, 2002 while Dattaguru Sawant and his
wife Manuja Sawant have also committed an offence punishable under Section
8, 10, 13(1)(d)&(e)  of the Prevention of Corruption Act, 1988 r/w 120 B
and/or Section 34 of the IPC.


Pointing out that Dattaguru Sawant was now residing in that very luxurious
flat at Risara Luxuria, in the complaint has also been alleged that
Dattaguru Sawant is currently spending a whopping twenty lakhs on
furnishing that flat which should also come under the scrutiny and scanner
of the investigation.


In the complaint it has also been pointed out that Dattaguru Sawant and his
spouse Manuja who is a housewife had purchased two Polo cars bearing
registration Nos  GA07K2111 and GA07Q2111.


It has been further stated that though the cars are hypothecated the salary
of Dattaguru Sawant and his spouse being a housewife is not sufficient to
service the two loans and on this count too he has committed offences
punishable under section 13(1) (d) & (e) while Dattaguru Sawant has also
reportedly not sought the required permission from the department to
acquire the vehicles.


In the complaint it has further been pointed out that Dattaguru Sawant  on
18th August 2014 at a auction conducted by the Goa Housing Board had bid
for a mind boggling amount of Rs. 1,45,86,000 for a plot admeasuring 483
sq. mtrs. at Durga Vaddo in Taleigao, for which purpose he had deposited an
amount of Rs. 1,00,000/-  which amount subsequently came to be forfeited as
he did not complete the payment of the bidded amount.


The details of payment of Rs. 1, 00,000/- towards that bid was not
disclosed to the higher authorities nor was the required permission sought
under the service rules towards the biding and forfeiture. Dattaguru Sawant
had also committed offences punishable under Section 13(1) (d) & (e) of the
Prevention of Corruption Act, 1988 r/w 120 B and/or Section 34 of the IPC.


While urging the DGP to direct the registering of an F.I.R against
Dattaguru Sawant and the other accused, it has been sought that the
complaint be promptly investigated strictly in accordance with law.


It has also been sought that the DGP issue other necessary directions that
he may deem fit and proper in view of the serious offences alleged against
Dattaguru Sawant who is a Police Inspector at the Crime Branch while the
mantra of the Government has been Zero Tolerance to Corruption.
