MS recent patent feeding frenzy was presumably with the aim of tearing
FLOSS to shreds with this kind of attack.

Sure, the FLOSS community may be able to rewrite all the currently disputed
code. But this is a great way to hobble its development to a snail's pace
and remove FLOSS from serious future consideration.

With MS's war chest, I'd expect them to put in an unending series of
further charges if linux ever gets anywhere near clearing up the currently
disputed code. I think it's a very serious threat, that doesn't have
really viable technical fixes.
