FAQ BOIKOT UPACARA ANGKAT SUMPAH PARLIMEN

1. Apakah tuntutan Suara Rakyat 505  kepada ahli-ahli Parlimen?

   Suara  Rakyat 505 menuntut ahli-ahli parlimen Pakatan untuk
boikot/tidak  menghadiri upacara angkat sumpah di Parlimen pada 24th Jun
2013



2. Kenapa?

Pertama  sekali, ia selari dengan kenyataan PR. Pakatan Rakyat telah
menyebut  sebelum ini tidak mengiktiraf keputusan PRU-13 yang lalu
kerana berlaku  banyak penipuan. Dalam masa yang sama, lebih dari 35
kerusi yang telah  dipetisyenkan . BERSIH juga  tidak mengiktiraf
Barisan Nasional sebagai  kerajaan



Kedua, untuk menarik perhatian media antarabangsa  terhadap Malaysia.
Ucapara angkat sumpah selalu diberi perhatian meluas  oleh media
antarabangsa. Kita memerlukan liputan media ini untuk  melawan arus
media yang bias dan mengingatkan rakyat tentang penipuan  pilihanraya.



3. Adakah MP yang memboikot upacara angkat sumpah akan hilang jawatan
mereka sebagai wakil rakyat?

Tidak.  Sememangnya tidak. Artikel 59 Klausa 2 , Perlembagaan
Persekutuan  menyatakan bahawa , ahli-ahli parlimen mempunyai masa
sehingga 6 bulan  untuk mengangkat sumpah sebelum kerusinya
diisyhtiharkan kosong.



Parlimen  "Standing Order" juga menuntut Speaker untuk membantu
MP mengangkat  sumpah secepat mungkin jika mereka tidak menghadiri sesi
pertama.  Asasnya, jika mereka tidak hadir pada hari tersebut, hari
seterusnya  mereka masih boleh dibantu Speaker untuk mengangkat sumpah

4. Apakah yang akan terjadi kepada MP PR yang menyertai boikot?

Mereka  akan terlepas dalam memilih Speaker Dewan.Untuk melantik Speaker
Dewan  hanya memerlukan majoriti mudah dan ini bermakna walau kesemua MP
PR  hadir sekalipun, BN yang mempunyai majoriti mudah boleh saja terus 
melantik sesiapa yang mereka mahu.



5. Tidakkah BN akan mencuba meluluskan apa-apa sahaja undang-undang
dengan ketiadaan MP PR?

Ada  sesetengah undang-undang yang hanya memerlukan majoriti mudah untuk
diluluskan, dan ada yang memerlukan majoriti â…"  untuk diluluskan.



Untuk  undang-undang dengan majoriti mudah,MP BN boleh meluluskannya
tanpa  kehadiran MP Pakatan. Untuk undang-undang dengan majoriti
â…" , BN tidak  boleh meluluskannya dengan ketiadaan MP Pakatan
Rakyat.



Dalam  mana-mana situasi, undang-undang baru memerlukan masa
berminggu-minggu  untuk dibawa ke Parlimen dan
didebatkan,dirangka-semula, didebatkan lagi  kemudian barulah ia
diluluskan.Maka , mustahil bagi Parlimen untuk  meluluskan undang-undang
dalam masa 24jam. Jadi perkara ini tidak harus  dirisaukan.



6. Pernahkah ia dibuat sebelum ini?

Ya,perkara ini adalah tindakan wajar yang biasa dilakukan dimana
keputusan pilihanraya tidak diterima sebagai sah.



Sebagai  contoh, pada tahun 2008, MP Mongolia memboikotsesi pertama
Parlimen  kerana mereka menganggap pilihanraya dipenuhi banyak penipuan.

Pada  tahun 2011, ahli-ahli pembangkang Turkey juga boikot upacara
angkat  sumpah di Parlimen untuk menunjukkan protes terhadap beberapa MP
yang  dipenjara oleh Erdogan, yang kini berdepan dengan protes
besar-besaran.

7.Dan dalam negara-negara ini, MP tidak kehilangan kerusi mereka?

  Tidak.  Sememangnya tidak.Inilah demokrasi. MP berhak untuk memboikot
angkat  sumpah kerana ini kebebasan meluahkan pendirian mereka.Ia sama
seperti  rakyat biasa yang memboikot sebarang acara/surat khabar kerana
tidak  berpuas hati dengannya. Mereka tidak kehilangan kerusi, malah
mendapat  liputan media secara meluas dlm masa yang sama menidakkan
tuntutan  kerajaan.





FAQ ON PARLIAMENT  SWEARING IN CEREMONY BOYCOTT

1. What is Suara Rakyat 505 asking Pakatan MPs to do?

Suara Rakyat 505 is asking Pakatan MPs to boycott/ not attend the
swearing in ceremony of Parliament on 24th June 2013.



2. Why?

Firstly,  it is consistent with PR's statements. Pakatan Rakyat has
stated it  does not recognise election results due to massive fraud. At
the same  time, more than 35 seats are being disputed in election
petitions.  BERSIH has also not recognised Barisan Nasional as the
government.



Secondly,  it is so that the international media can focus on Malaysia.
The  swearing in ceremony is always covered widely by the international 
media. We need this media coverage to counter the biased mass media 
coverage and remind people of the fraudulent elections.



3. Will the MPs who boycott the swearing in lose their seats?

NO.  Absolutely not. Article 59 Clause 2 in the Federal Constitution
states  that there is a 6 month period for a MP to be sworn in before
his seat  is declared vacant.



Parliament Standing Orders also compel  the Speaker to help MPs be sworn
in as soon as possible should they  miss the main ceremony. Basically,
they miss one day, and the next time  they show up the Speaker will help
them to be sworn in.

4. What will the PR MPs who boycott miss?

They  will miss the choosing of the Speaker of the House. However, to
choose  the Speaker of the House only needs a simple majority, so even
if all PR  MPs were present, BN who has a simple majority can just go
ahead and  choose whoever they want anyway.



5. Won't BN try to pass all sorts of laws with Pakatan Rakyat MPs
absent?

Well,  there are certain laws that require a simple majority, while
others  require a two-thirds majority to pass. This majority is out of
the whole  parliament.



For the laws with a simple majority, BN MPs  can pass them anyway, even
with Pakatan MPs. For laws with two-thirds  majority, BN cannot pass
them without Pakatan MPs being present.



In  any case, new laws take weeks to be brought to Parliament, debated, 
redrafted, debated and then passed. It is impossible to pass a law from 
start to finish within a few hours/ one day, so this should not be a 
concern.



6. Has this kind of action been done before?

Yes, in fact this kind of action is standard practice in situations
where election results are highly disputed.



For  example, in 2008 Mongolian MPs boycotted the first session of 
Parliament because they said the elections were full of fraud.

In  2011, Turkish opposition members also boycotted the swearing in 
ceremony of Parliament to protest against certain MPs being jailed by 
Erdogan, who is now facing massive protests.

7. And in these other countries, the MPs didn't lose their seats or
anything?

No,  they did not. That is what democracy is about: an MP has a right to
boycott the swearing in as part of his freedom of expression. Just like 
how ordinary citizen have the right to boycott events/ newspapers etc to
show his dissatisfaction. They did not lose their seats but gained 
worldwide media attention, while not bowing down to demands of the 
government.
