I have actually tried what googleboy suggested and it works!
What I did was remove the link(in unix) to javax.servlet.jar and create a link
to file jbossweb-tomcat.sar/jsp-api.jar.
However I would like to know if this would potentially break anything?

Delete javax.servlet.jar in your {jboss deployment directory}/lib and copy. It's
clashing with a newer one in your tomcat sar directory called jsp-api.jar.
