The Modharaba is a silent partnership where Rab al Maal participates with the
capital and the Mudhareb with his skills; it is based on profit sharing and
loss bearing principle.
In case of loss the Mudhareb will loose the time and efforts invested while Rab
al Maal will loose the capital, save fore the aforesaid, the case of fraud or
negligence of the Mudhareb.
The application of this principle, though it is based on Sharia’a principles,
however, it does not comply with the state laws, especially Consumer/Customer
Protection Acts. Therefore, the first part of the principle “Profit Sharing” is
acceptable; while, the second part of the principle “Lost Bearing” is not
acceptable.
So, the capital should be guarantied by the bank in all cases, which means in
case of loss, the bank will bear all losses on its own.
True that the application of Mudharaba is not 100% Sharia’a compliant, however,
it forms a protection for the clients of banks and pushes the banks to measure
all the risks and to give a lot of attention to each project, thus, the
protection is dual, the depositors and the shareholders.
