Initially MS tried to patent the formats spoken about in that open letter.
There are a few good sites detailing the falsity of Microsoft's claims

I read an interesting article on kind of related to this yesterday in LXF...
The upshot is that when you buy Vista with the M$ office trial the option to
save in anything other than Office XML (DOCX?) is disabled. Likewise you
can't copy the text in said document and paste it into another document
