Solved,
adding references to the project (Hans Milling post) and
ModelSetup.Initialize() at startup of the web site (Jackie NG post) solved
the problem.

And call ModelSetup.Initialize() in your application's entry point. This will
make all > 1.0.0 schema versions known to the Maestro API

What version (xml/schema) is the Layer definition?
If it is above 1.0.0 make sure that you add a reference to the
OSGeo.MapGuide.ExtendedObjectModels.dll.
