They can't do it they could loose their contract! Just like the people who do
a minimum amount to run a card is against the contract. It just takes one
person to report it. Besides I'd rather pay the small percentage then have to
worry about going to the bank to make deposits!

Actually in some states it might be illegal to charge a fee for using
the credit card.. I know I read that somewhere.. if I get a minute
I'll do some googling.. just like exp dates on GC's are against the
law in some places.. I am thinking the same applies here..

Remember, being illegal and against TOS are two very different things.
Square could simply drop you if they learned you were passing on a fee, but
there are no legal ramifications.
Set your pricing based in credit and debit card purchases, and offer a
discount for cash or check. It's as simple as
