Depends on the kind of licensing deal you have with MSFT.
As I recollect, that's part of SA or EA or Select licensing. Not retail or open.

controller if the original domain controller was never coming back (in
other words, it is a replacement, not an addition). I can't imagine
what kind of problems you could create by bringing up a new box that was
P2V'd from a DC, but I

This is how we built our virtual domain controller. We actually used a W2K3
template to build the os from, & then added to the domain, ran updates, then
ran dcpromo on it. And yes, you will need to comply with licensing
requirements.

Do NOT P2V a DC without permanently destroying (i.e., format) the physical DC.
You need to build a new DC, P or V doesn't matter, promote it, change the IP
address to the final IP address, shut it down, and put it in its permanent
location, and move it to the proper site in AD Sites and Services
I would recommend building a VM from scratch and running dcpromo on it.
